<br />I: <br /> <br />J. <br /> <br />I~ <br /> <br />RESOLUTION No. 04-043 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND DENYING VN 04-01. <br /> <br />WHEREAS, an application for a variance has been made by Mr. Paul Schweppe to construct a 843 <br />square foot garage located at 1227 12th Ave NW; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br /> 1. <br /> 2. <br />) , <br />I <br /> 3. <br />i; <br /> <br />An application for a special use permit was filed with the City of New Brighton on April <br />27,2004. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on May 18,2004 and all present were given a chance to freely speak at the <br />hearing; <br />The City Council heard the request and approved the variance application to add onto <br />the existing garage; and, <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to VN 04-01: <br /> <br /> 1. <br />, I 2. <br />. i <br />" <br />I I 3. <br />I, <br />I! 4. <br />, i <br /> 5. <br />1 ~ 6. <br /> 7. <br /> 8. <br /> <br />! : <br /> <br />The subject site is zoned R~l, Single Family Residential. <br /> <br />The applicant is requesting a variance to construct an addition on to an existing <br />detached garage over 600 sq. ft. <br /> <br />The total size proposed is 843 square feet. <br /> <br />When an attached garage is present, the Zoning Code limits detached garages to 600 sq. <br />ft. <br /> <br />The city of New Brighton Zoning Ordinance, Section 4-530 E, limits detached <br />accessory structures to 600 sq. ft. when an attached garage is present. <br />The applicant's property has an attached garage; and the applicant enjoys a detached <br />garage which is 616 sq. ft. <br /> <br />The applicant is proposing to expand the existing detached structure by 227 sq. ft. to a <br />total size of 843 sq. ft. <br /> <br />Where there are practical difficulties or unusual hardships in the way of carrying out the <br />strict letter of the provisions of the City of New Brighton Zoning Ordinance, the <br />Council shall have the power, in a specific case, to permit a variance from the <br />provisions of this ordinance. The crucial points of the variance are: <br /> <br />a. Undue hardship <br /> <br />b. Unique circumstances <br />c. Conformance with the Comprehensive Plan <br /> <br />d. Variance shall not be detrimental to adjacent property or to the public as a <br />whole. <br /> <br />9.
