I" <br />, , <br />I: <br />! <br /> <br />RESOLUTION NO. 04-032 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />lRESOLUTION making findings of fact and approval of an application for <br />i IContamination Grant Cleanup funds for a portion of the Northwest <br />: !Quadrant. <br />i i <br />I lWHEREAS the City of New Brighton (hereinafter, "the City") has committed to the <br />! jredevelopment of the Northwest Quadrant area through property acquisitions, <br />! ideveloper designation, and technical and financial planning, and <br />Ii <br />, ) <br />IIWHEREAS the City has incurred and expects to continue to incur costs for <br />i ! environmental assessment and remediation, and <br />, <br />! <br />, WHEREAS the State of Minnesota offers a grant program to assist local units of <br />government in the paying for such costs, <br /> <br />BE IT RESOLVED that the City hereby approves the Contamination Cleanup <br />grant application to be submitted to the Department of Employment and Economic <br />Development (DEED) on May 1, 2004 (hereinafter, "the application"), by the City, <br />for the "Northwest Quadrant - RR, Haines, Post Office and portions of the Miller <br />dump" site. <br /> <br />BE IT FURTHER RESOLVED that the City agrees to act at the legal sponsor for <br />the project contained in the application to be submitted on May 1, 2004 and that <br />i the City Manager is hereby authorized to apply to DEED for funding of this project <br />i! on behalf of the City. <br />, ! <br /> <br />i BE IT FURTHER RESOLVED that the City has the legal authority to apply for <br />financial assistance, and the institutional, managerial, and financial capability to <br />, ensure adequate project administration. <br /> <br />: ~ BE IT FURTHER RESOLVED that the sources and amounts of the local match <br />" <br />; ,! identified in the application are committed to the project identified. <br /> <br />, BE IT FURTHER RESOLVED that the City has not violated any Federal, State or <br />! 1 <br />local laws pertaining to fraud, bribery, graft, kickbacks, collusion, conflict of <br />interest or other unlawful or corrupt practice. <br /> <br />BE IT FURTHER RESOLVED that upon approval of its application by the state, <br />the City may enter into an agreement with the State of Minnesota for the above- <br />referenced project, and the City certifies that it will comply with all applicable laws <br />and regulation as stated in all contract agreements. <br /> <br />I f BE IT FURTHER RESOLVED that the City Manager is hereby authorized to <br />execute such agreements as are necessary to implement the project on behalf of <br />the applicant <br />
