<br />"! <br /> <br />" 'j <br />i I <br /> <br />i: <br /> <br />RESOLUTION No. 04-012 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />: : <br />1 ~ <br />i, <br />'( ~ <br />, I <br />! j <br />i i <br />i i <br />I' <br />RESHLUTION MAKING FINDINGS OF FACT AND APPROVING of SP03-13 and LP03-09: <br /> <br />i i <br />WHf~EAS, an application for a special use permit and site plan review has been made by Mr. Norm Wells, <br />, ! architect, on behalf of Me Mike Dooley to expand the building on site for a truck repair facility and <br />j ; outdoor storage on site. <br />; ) <br />, , <br />WH~EAS, the procedural history of the application is as follows: <br />; 11. An application was filed with the City of New Brighton on December 31st, 2003. <br />i 12. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />i i January 20, 2004 and all present were given a chance to freely speak at the hearing; and, <br />I '3. The City Council considered the request on January 27,2004. <br /> <br />, <br />, I <br />NowjTHEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact: <br /> <br />i i 1. <br />; l <br />,2. <br />i' <br />j ~ <br />:: 3. <br />:! <br />Ii <br />: 1 <br />i I <br />; ; <br /> <br /> <br />, I <br />i i <br />, i <br />! ; <br /> <br />5. <br /> <br />The subject site is zoned 1-2, Heavy Industrial. <br /> <br />The applicant is requesting a Special Use Permit to conduct a truck repair facility and to store <br />equipment outside on site. <br /> <br />Special uses may be permitted in zoning districts by the City Council where such uses are deemed <br />essential or desirable to the public convenience and welfare, and are in harmony with the various <br />elements or objectives of the comprehensive plan, and if their location, plan, and character of the <br />development are first considered by the Planning Commission following the procedure set forth in <br />the Section 8-130. <br /> <br />As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall be <br />recommended by the Planning Commission unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be detrimental to <br />or endanger the public health, safety, morals, comfort of general public. <br />b. That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already pennitted, nor substantially diminish and impair <br />property values within the neighborhood. <br />c, That the establishment of the special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided. <br />e. That the special use shall, in all other respects, conform to the applicable regulations of the <br />district in which it located. <br /> <br />The Planning Commission found the special use standards satisfied and recommended approval to <br />the City Council. <br /> <br />The City Council finds the special use standards satisfied. <br /> <br />6. <br /> <br />i <br />; ! <br />BE IT ~SOLVED, the application SP03-13 and LP03-09 is hereby approved by the City Council with the <br />follqwing conditions: <br />Ii <br />, , <br /> <br />H~' Approval and compliance with all requirements from Rice Creek Watershed District. <br />~ The storage and parking areas are paved with bituminous or concrete surface. <br />S'.
