<br />~ <br /> <br />That the establishment of the special use will not impede the <br />normal and orderly development and improvement of the <br />surrounding property for uses permitted in the district. <br />That adequate utilities, access roads, drainage and/or necessary <br />facilities have been or are being provided. <br />That the special use shall, in all other respects, conform to the <br />applicable regulations of the district in which it located. <br /> <br />5. <br /> <br />The Planning Commission found that the special use standards satisfied and <br />recommended approval to the City Council. <br /> <br />The City Council finds the special use standards to be met on January 13, <br />2004. <br /> <br />6. <br /> <br />! : <br /> <br />; BE IT FURTHER RESOLVED, the application SP04-0 I/LP03-08 is hereby approved by the <br />City Council with the following conditions: <br /> <br />I <br />i, <br />: i <br />\ ~ <br /> <br />1. All necessary zoning approvals shall be submitted to the City including <br /> <br />a. An amendment to the City's Comprehensive Plan; <br /> <br />b. Rezoning of the portion of the Thermo King lot included in this <br />proposed Beisswenger site plan; <br /> <br />c. Combination ofthe existing parcels and re-platted into one lot of <br />record; and, <br /> <br />d. A special use permit for a comprehensive sign plan. <br /> <br />2. The applicant shall work with the City to study the Old Highway 8 NW and <br />Highway 96 intersection and shall incorporate any recommendations into the <br />site plan including amenities such as sidewalk on the site. <br /> <br />3. The storage of any packaging, propane tanks, garbage or recycling material <br />shall be stored inside the building. <br /> <br />4. Outdoor "Garden Sales area" can include shrubs, fountains, bagged materials <br />such as soils and manure, mulches, trees, and small utility sheds located against <br />wall which shall not exceed 120 sq. ft. <br /> <br />5. Limited display carts shall be allowed near the main door on the south fayade <br />as shown on the site plan. <br /> <br />6. A snow removal plan is submitted and approved by Staff. <br /> <br />7. The applicant shall submit additional detailed plans on the outdoor garden sales <br />area and approved by the City Planner for consistency with design standards. <br /> <br />8.
