<br /> <br /> <br /> i <br /> s <br /> <br /> RESOLUTION No.07-119 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> <br /> RESOL ' ION MAKING FINDINGS OF FACT AND APPROVING OF AN AMENDMENT TO SITE PLAN <br /> LP20~~-001 DOCUMENTED UNDER RESOLUTION 406-029. <br /> i! <br /> WHEIM~ s, an application has been made by FW Gordon Construction to be considered for an <br /> amendment to a previously approved Site Plan, which revises the materials proposed for the <br /> exte ' r of the building at 1820 Old Highway 8 NW, known as the Rush Lake office building. <br /> <br /> WHERE ~s, the procedural history of the application is as follows: <br /> 1. T City Council approved LP2005-006 on April 26, 2005. <br /> 2. T City Council approved LP2006-001 on March 28, 2006. <br /> 3. A r. application for a Site Plan Amendment was received on November 2, 2007. <br /> 4. T Planning Commission provided a recommendation of the proposal on November 20, <br /> 20P. <br /> 5. T e City Council considered the request on November 27, 2007. <br /> <br /> WHE S, the Planning Commission and City Council make the following Findings of Fact with <br /> resp to the amended Site Plan (LP2007-012): <br /> 1. e Site Plan was previously approved in Resolution 06-029 and outlines development of the <br /> s in compliance with the MX district standards. <br /> 2. solution 06-029 reflects the re-approval of the Site Plan and Special Use Permit originally <br /> a ' and documented under Resolution 05-036. <br /> 3. Troved <br /> revised building elevations are consistent with the General Performance standards noted <br /> i Section 6-390. <br /> 4. 11 e revised building elevations are consistent with the MX district performance standards of <br /> Section 6-570 (2), provided the applicant breaks up the western fagade with a secondary <br /> ilding material. <br /> 5. e exterior cornice element must remain, although it can consist of a material that imitates <br /> s ne, and must wrap around the entire building between the 2nd and 3rd floors. <br /> 6. e amended Site Plan does not impact any other zoning requirements as to building height, <br /> backs, floor area ratios, parking, etc. <br /> 7. e proposed revision does not impact any of the conditions noted in Resolution 06-029. <br /> <br /> Now JQ[IEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Si Plan Amendment (LP2007-012) is hereby approved in accordance with attached Exhibit <br /> A, s ject to the following condition: <br /> Continued compliance with Resolutions 06-029. <br /> <br /> r3 <br /> <br /> <br /> I~ <br /> I; <br /> <br /> I:\CO>~J ICIL\REPORTS\2007\Community Development\11-27-2007\LP2007-012 (FW Gordon) - RESOLUTION.doc <br />
