<br /> <br /> <br /> i <br /> ii <br /> t <br /> r! <br /> l <br /> RESOLUTION No.07-120 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAmSEY <br /> CITY OF NEw BRIGHTON <br /> s - <br /> RESOL 'ION MAKING FINDINGS OF FACT AND APPROVING A PRELIMINARY PLAT. <br /> i <br /> i <br /> WHERE, s, an application has been made by William John Harris for consideration of a <br /> Preli nary Plat for property located at 1239 12th Avenue NW, creating one additional lot for <br /> devel ment of a single family home. <br /> WHERE . s, the procedural history of the application is as follows: <br /> 1. An application for a Preliminary Plat was submitted on November 2, 2007. <br /> 2 The Planning Commission, pursuant to published and mailed notices, held a public <br /> hearing on November 20, 2007 and all present were given a chance to freely speak at the <br /> ° hearing. <br /> 3 The Planning Commission considered the request on November 20, 2007, held a public <br /> hearing, and recommended unanimous approval subject to 8 conditions. <br /> WHE s, the Planning Commission and City Council make the following Findings of Fact with <br /> respe to the Preliminary Plat (PL2007-005): <br /> 1 The property is located at 1239 12'' Avenue NW. <br /> 2 The property is zoned R-1, Single Family Residential. <br /> 3 The property is guided in the Comprehensive Plan for Low Density Residential. <br /> 4 The total property area is approximately 1.6 acres. <br /> 5 The existing property is legally described as follows: <br /> Lots 34 and 35, except the West 8 feet, Auditor's Subdivision No. 79, Ramsey <br /> County, Minnesota. <br /> 6 ' The proposed legal descriptions are as follows: <br /> Lot 1, Block 1, Donaldson Lake Estates, Ramsey County, Minnesota <br /> <br /> And <br /> Lot 2, Block 1, Donaldson Lake Estates, Ramsey County, Minnesota <br /> The Planning Commission recommended conditional approval of the Preliminary Plat in <br /> i ; accordance with City Code Section 26-33. <br /> In accordance with Section 26-31 (9) the preliminary plat shall remain in effect for a <br /> period of 12 months from the date of Council approval. <br /> <br /> Now EREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a Pr iminary Plat (PL2007-005) is hereby approved in accordance with attached Exhibit A, <br /> subject to the following conditions: <br /> The applicant shall file for final plat approval within 12 months of the date of Council <br /> approval of the preliminary plat. <br /> j At the time of final plat submittal the applicant shall pay park dedication fees for the <br /> j newly created lot, amounting to $1,550. <br /> B~ <br /> <br /> I:\COt CIL\REPORTS\2007\Community Development\l 1-27-2007\PL2007-005 (Harris) - RESOLUTION.doc <br />
