<br /> <br /> <br /> 1 <br /> j! <br /> ti <br /> 3 <br /> RESOLUTION No.07-121 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> i' <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF A NONCONFORMING USE PERMIT. <br /> WHE lks, an application has been made McMonigal Architects, on behalf of Robert and Jo <br /> Nore to permit construction of an addition to the rear of the home and various other interior <br /> and terior improvements, where the existing home is setback 26' from the front property line <br /> and ' from the southern side lot line at 1842 Long Lake Road, and <br /> <br /> WHE s, the procedural history of the application is as follows: <br /> 1. Abi application for a Nonconforming Use Permit was received on November 7, 2007. <br /> 2. Tie Planning Commission, pursuant to a mailed notice to property owners within 350', held <br /> a rbrlic hearing on November 20, 2007 and all present were given a chance to freely speak at <br /> t hearing. <br /> <br /> 3. 4e Planning Commission considered the request on November 20, 2007, held a public <br /> ing, and vote unanimously to approve. <br /> <br /> WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br /> resp t to the Nonconforming Use Permit (NC2007-006): <br /> 1. e property is zoned R-1, Single Family Residential. <br /> 2, e property is guided in the Comprehensive Plan for Low Density Residential. <br /> 3. e property is legally described as follows: <br /> The East 335.35 feet of the South 66.15 feet of the North 330.74 feet of the Southwest <br /> Quarter of the Southeast Quarter of the Southeast Quarter of Section 18, Township 30 <br /> North, Range 23 West, subject to rights of public over the East 33 feet thereof for road <br /> purposes. <br /> 4. e applicant has proposed to construct an addition to the rear of the home, as well as other <br /> interior and exterior improvements. <br /> 5. e existing front yard setback is approximately 26' where 30' is normally required. <br /> 6. e existing southerly side yard setback is approximately 4' where 5' is normally required. <br /> <br /> 7. e Planning Commission and City Council considered the proposed Nonconforming Use <br /> rmit in accordance with Zoning Code Section 8-460, which identified Type 4 <br /> nconformities. <br /> 8. a Planning Commission and City Council determined that the nonconformity couldn't be <br /> duced or eliminated but that the proposed improvements would not increase the <br /> li nconformity or negatively impact adjacent property. <br /> I <br /> Now HEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for <br /> a N conforming Use Permit (NC2007-006) is hereby approve. <br /> <br /> <br /> <br /> <br /> <br /> IXO CIL\REPORTS\2007\Community Development\11-27-2007\NC2007-006 (Norell) - RESOLUTION.doc <br /> f <br />
