<br /> <br /> z <br /> 'h <br /> i~ <br /> 1 <br /> RESOLUTION N0.07-122 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> ~g <br /> RESOLL,f ION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND SPECIAL USE PERMIT. <br /> 9t <br /> WHERE' IS, an application has been made by Brian Drerup on behalf of Mission Foods and 614 <br /> Comp y to permit two 48' tall silos, one already erected, at 1565 1" Avenue NW. <br /> <br /> WHERE S, the procedural history of the application is as follows: <br /> 1. Ait application for a Site Plan was received on October 1, 2007 and an application for a <br /> S cclal Use Permit was received on November 6, 2007. <br /> 2. T ¢ Planning Commission, pursuant to published and mailed notices, held a public hearing <br /> o ~ ovember 20, 2007 and all present were given a chance to freely speak at the hearing. <br /> 3. T101, Planning Commission held a public hearing and recommended approval of a Zoning <br /> Code amendment impacting Sections 6-050 and 6-140 that would permit erection of such <br /> st cture in excess of 40 feet in height by Special Use Permit. <br /> 4. T Planning Commission recommended approval of the Site Plan and Special Use Permit <br /> s 'ect to conditions. <br /> <br /> 5. T City Council considered the request on November 27, 2007. <br /> <br /> WHER s, the Planning Commission and City Council make the following Findings of Fact with <br /> respe to the Site Plan (LP2007-010) and Special Use Permit (SP2007-013): <br /> 1. T property is zoned I-1, Light Industrial district. <br /> 2. T 1-1 property is guided in the Comprehensive Plan for Light Industrial. <br /> 3. T Planning Commission and City Council considered the Site Plan in accordance with I-1, J <br /> L ht Industrial district standards and determined that the proposal complies with all <br /> s acks, floor area ratio and sign requirements subject to correction of the 5' parking <br /> s( ack to the northern lot line. <br /> 4. S tion 6-050 (4), per a proposed Zoning Code amendment, permits accessory structures in <br /> I-1 district to exceed 40' in height subject to the following conditions: <br /> a. The property is located adjacent to the right of way of Interstate 35W. <br /> b The accessory structure is located in the rear or side yard. <br /> c The accessory structure meets setback requirements for principal structures. <br /> d No adjacent properties are zoned residential. <br /> e. The accessory structure is located no farther than 10' from the principal structure. <br /> f. The accessory structure height is no more than 160% of the height of the principal <br /> structure, and in no case more than 50'. <br /> g The lot area of the property on which the accessory structure is located on is at least 5 <br /> acres. <br /> h The property is in compliance with the performance standards of Section 6-390. <br /> i.
