RESOLUTION NO. <br />08-008 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT. <br />(HERE 3, an application has been made by Sussel Corporation on behalf of Scott Miller to permit <br />const tion of an addition to the existing attached garage whereby the total square footage <br />would ceed 624 s.f. at 823 Torchwood Court, and <br />'HEREAS, the procedural history of the application is as follows: <br />1. An pplication for a Special Use Permit was received on December 21, 2007. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on January 15, 2008 and all present were given a chance to freely speak at the hearing. <br />3. Th Planning Commission recommended approval on January 15, 2008. <br />4. Th City Council considered the request on January 22, 2008. <br />THERE S, the Planning Commission and City Council make the following Findings of Fact with <br />respec to the Special Use Permit (SP2008-001): <br />1. The property is zoned R-1, Single Family Residential. <br />2. Thc property is guided in the Comprehensive Plan for Low Density Residential. <br />3. T1 t property is legally described as follows: <br />Lot 10, Block 3, Innsbruck East, Ramsey County, Minnesota <br />4. Thl applicant has proposed to construct an addition to the existing attached garage whereby <br />thi I, total square footage would exceed 624 square feet at 998 square feet. <br />5. TILT Planning Commission and City Council considered the proposal in accordance with <br />Zoning Code Section 4-530 (1) (E) which requires approval of a Special Use Permit for any <br />amessory building (including attached garages) in excess of 624 square feet. <br />6. T Planning Commission and City Council considered the proposed Special Use in <br />a ordance with Zoning Code Section 4-530 (1) (K) which requires that the garage meet the <br />folowing conditions: <br />a. Roof and exterior color and material must be consistent and complimentary with the <br />principal structure. <br />b. If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />c. No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />7.
