Johnson, Assistant to the City Manager <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this report _ Comments attached <br />Recommendation: <br />City Council approval of an Ordinance that amends section 2.153 (Subd. 1, Subd. 2) of the New <br />Brighton City Code. <br />Explanation: <br />City staff recently completed a review of Article 5 "Licenses and Permits" located in the New <br />Brighton City Code. City staff is recommending that changes be made to the wording of Section <br />2-153 regarding the refunding of application fees. The original ordinance was adopted by the <br />City Council in 1977. The current ordinance requires that the City Council approve all customer <br />refunds for licenses and permits that are issued by the City. In order to streamline the process, <br />the matter should be handled administratively. City staff is recommending that the City Manager <br />or his/her designee be granted the authority to issue customer refunds. <br />Current Language - <br />Sec. 2-153. Refund of Fees. <br />The terms of this Section shall apply to the refunding of an application fee. <br />(1) No application fee shall be refunded unless specifically authorized by the City Council. An applicant <br />must submit a written request which includes the reason for the refund to be eligible for a refund. <br />(2) In receiving the request for a refund, the City Council shall consider the costs incurred in processing <br />the application. A partial refund may be authorized by the City Council. In its discretion, the City <br />Council may deny a request for a refund. <br />(3) An application which is denied for failure to comply as specified in Section 2-152 shall not be eligible <br />for a refund.
