II& <br />WORKSESSION MATERIAL <br />ltfL�i <br />dx, +tt tl�r1i to rh" tint' t r <br />Memo <br />To: City Manager, Mayor, and City Council <br />From: Janice Gundlach, City Planner <br />Grant Fernelius, Community Development Director � <br />Subject: Proposed Amendments of Chapter 9 of the Zoning Code <br />Regarding Electronic Signs <br />Date: February 20, 2008 <br />On March 27, 2007 the Council adopted a moratorium impacting the "erection, <br />relocation, repair, or modification of static or changing electronic, digital video, <br />display signs, billboards or freeway signs and flashing, motion, animated, <br />changeable copy and illuminated signs." This action was in direct response to <br />the billboard industry's implementation of new LED billboards. <br />Since that time, staff has been awaiting the outcome of a lawsuit on this issue <br />between the City of Minnetonka and Clear Channel, as well as the conclusion of <br />a study done by SRF Consulting regarding the traffic safety impacts of these <br />types of signs. Staff has also been tracking how other cities have been <br />responding to their moratoriums, in terms of legislative changes to their sign <br />codes. <br />Based on the issues noted above, staff has prepared an amendment to Chapter <br />9 of the Zoning Code, which regulates signs. The proposed amendment covers <br />the following: <br />• Replaces the term electronic with dynamic and defines terms used within the <br />code but not previously defined, such as animation, revolving, scrolling, <br />spinning, etc. <br />• Replaces all reference to the Minnesota Building Code with International <br />Building Code, <br />• Updates the Nonconforming section of the code to comply with State law, <br />which was amended in 2003 to allow the replacement of nonconforming uses, <br />including signs, <br />• Places conditions on dynamic signs. <br />19COUNCI["REPORI'S' uPti R,:nnm D ,nnC U]BAWo,Asc..
