City of New Brighton requests approval of a Zoning Code Amendment (ZA2007-003) impacting Chapter 9 of the Zoning Code concerning electronic, changeable copy signs. ReportNo. 08-091. Ordinance No. 758. City Planner, Janice Gundlach explained that a moratorium was adopted in March 2007 Ms. Gundalch provided an overview of staffs research in the past year. The proposed amendment would establish uniform regulations, require little interpretation, in addition to clearing up conflicting language in the current zoning code. The amendment proposes limiting flashing to once every 45 seconds, a separation of 35feet, and brightness limitations. Ms. Gundlach explained the measuring of brightness, explaining compliance determination can be difficult. Staff recommends a manufacture's certification that the signs will not exceed the following levels: Daytime- 5,000-7,000 nits Nighttime -500 nits The Planning Commission recommends approval of the ordinance. Councilmember Phillips suggested following Mn DOT with the 8 second flashing limitation instead of the proposed 45 second time. The other Councilmembers agreed with Councilmember Phillips. Motion by Councilmember Phillips, seconded by Councilmember Doffing to approve the ordinance with the following change: The flashing standard be changed from the proposed 45 seconds, to follow the MnDOT standard. 5 Ayes — 0 Nays, Motion Carried Commission Liaison Reports, Announcements and Updates: Dean Lotter Mr. Lotter reported the TIF pooling of district 26 was adopted, the other two TIF pooling districts have not yet had a hearing. The $6 million bonding bill did not make it to the House or Senate. The Employee Appreciation breakfast was held March 6'h. Deputy Director Dan Olson was awarded the Michael J. Walker Spirit Award. Mr. Lotter requested Council direction on Advisory Commission terms that are expiring March 31, 2008. Council requested applications to review. Councilmember Doffing Councilmember Doffing described 2007 as a Banner Year for the City, and extended her gratitude to City Staff for all their contributions. Congratulations were offered to Deputy Director Olson on his receiving the Michael J. Walker Spirit award The Planning Commission will be discussing the installation of a cell tower at Hidden Oaks Park.
