Mann replied that is a specific type of care that is compatible with the <br />church. <br />Baker stated if the Commission used the objections to the development, which include increased <br />traffic, and preservation of the land and view, no land in the City would ever be developed. Zisla <br />replied that the original proposal did generate quite a bit of discussion by the Commission <br />regarding if this proposal would be in the best interest for the area. He added that when the new <br />proposal was brought forward, some Commission members were concerned that changes had <br />been made that were in conflict with the approved 2005 plan, however the applicant addressed <br />the issues by redesigning parking and increasing the landscape buffer. <br />O'Keefe asked if a condition could be added to limit this development to a six -bed facility. <br />Gundlach replied that condition would be added to the Planned Development Declaration and it <br />could be added under the conditions of the preliminary approval. O'Keefe stated that this is a <br />less intrusive commercial use and believes the size of the facility would not be commercially <br />viable for any other more intensive use. <br />Motion by Baker, second by Schiferl to APPROVE THE PROPOSED PRELIMINARY PLANNED <br />RESIDENTIAL DEVELOPMENT AND SITE PLAN SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. The property is developed in accordance with the submitted Site Plan (revised 2/12/08), <br />Grading, Drainage & Erosion Control Plan, Utility Plan, Landscape Plan (revised), and <br />Electrical Plan. <br />2. The applicant submits for final Planned Residential Development approval within 90 <br />days of preliminary PRD approval, per Section 7-040 (E). Final PRD approval must be <br />reviewed by the Planning Commission and City Council. <br />3. Minor Subdivision approval is granted only in conjunction with final PRD approval. A <br />separate Resolution will be provided for the Council's adoption. <br />4. As part of the Minor Subdivision approval the applicant must pay a park dedication fee, <br />amount to be determined by the City Council. <br />5. Prior to issuance of any building permits, the applicant must provide a copy of an <br />executed and recorded Shared Access and Parking Easement in a form satisfactory to the <br />City Attorney. <br />6. The applicant adheres to the comments contained in the Interoffice Memo RE <br />Engineering Matters, drafted by Bob Rutherford and dated 1/9/08. <br />7. A revised Lighting Plan is submitted illustrating compliance with a 0.4 foot-candle <br />maximum at the northerly and easterly lot line. <br />8. At the time of final PRD approval, the applicant shall submit a Parking Plan illustrating <br />existing, proposed, and proof of parking stalls. <br />a. Building permits will not be issued until final Planned Residential Development and <br />Minor Subdivision approvals have been granted by the City Council. <br />10. The applicant agrees to enter into a Planned Development Declaration including the <br />conditions noted above and including, but not limited to the following: <br />a. Proof -of -parking is constructed at the discretion of the City. <br />b. The landscaping providing screening at the eastern lot line, abutting 1230 Long <br />Lake Road, is maintained indefinitely. <br />c. The facility shall be limited to 6 licensed nursing beds and 2 rest and study beds <br />only. <br />6 ayes, 1 nays. Motion Approved. <br />
