RESOLUTION N0.08-033 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND SPECIAL USE <br />WHEREAS, an application has been made by Wash N Fill Properties New Brighton to I Permit <br />construction of a 10' x 18' addition to the north end of the existing car wash bay locat t 201 <br />West County Road E2. <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Site Plan and Special Use Permit were received on February 19, 2( <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />on March 18, 2008 and all present were given a chance to freely speak at the hearing. <br />3. The Planning Commission recommended approval on March 18, 2008. <br />4. The City Council considered the request on March 25, 2008. <br />WHEREAS, the Planning Commission and City Council make the following Findings of F 4 t with <br />respect to the Site Plan (LP200-003) and Special Use Permit (SP2008-005): <br />1. The property is zoned B — 3, General Business. <br />2. The property is guided in the Comprehensive Plan for Community Business. <br />3. The property is legally described on attached Exhibit A. <br />4. The Planning Commission and Council considered the Site Plan in accordance with t B — 3 <br />district standards of Section 5-250, the commercial performance standards of Sectio -390, <br />and the parking standards of Chapter 11 of the Zoning Code. <br />5. The Planning Commission and Council found all applicable Site Plan standards to be i r et. <br />6. The Planning Commission and Council reviewed the proposal in accordance vith the <br />following Special Use Permit conditions of Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will ilot be <br />detrimental to or endanger the public health, safety, morals, comfort or general we are. <br />b. That the special use will not be injurious to the use and enjoyment of other prop rty in <br />the immediate vicinity for the purposes already permitted, nor substantially dimir i 3h and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and arderly <br />development and improvement of the surrounding property for uses permittec in the <br />district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have bee or are <br />being provided. <br />e. That the special use shall in all other respects conform to the applicable regulatior of the <br />district in which it is located. <br />7.
