c,~ RESOLUTION No 03-076 STATE OF MINNES TA COUNTY OF RAMS Y CITY OF NEW BRIG TON RESOLUTION MAKING FINDINGS OF FACT AND ApPROVAL F A PLANNED UNIT DEVELOPMENT (PUD) FOR BRIGHTON VILLAGE PUD03-02; WHEREAS, an application has been made by Kraus Anders n, Inc. for Engelsma Limited Partnership to be considered for a Final PUD review by the City Co unci . WHEREAS, the procedural history of the application is as fi 110ws: 1. An application for Final PUD Review, Sit Plan, and Final Plat was filed with the City of New Brighton on August 3,2003. 2. The Planning Commission, pursuant to pu lished and mailed notices, held a public hearing on August 19,2003 and an person present at the hearing were given an opportunity to be heard. The Planning Co mission considered the plans and recommended preliminary review approv I subject to conditions. 3. The City Council heard the request and a roved the preliminary plan on August 26, 2003. 4. An application for a Final PUD review an Final Plat was filed with the City of New Brighton on October 3,2003. 5. The Planning Commission reviewed the nal plan on October 21,2003 and all persons present were given an opportunity to be hard. The Planning Commission considered the plans and recommended final review pproval subject to conditions. 6. The City Council heard the request and a proved the proposal with conditions. ; i i ~ \ ~ WHEREAS, the Planning Commission makes the followi g Findings of Fact in respect to PUD03-02: ; : 1. The site is zoned B-3, General Business. 2. Under a Planned Unit Development St II approval process, increased density, height limitations, and land uses are reviewed a d considered. 3. The Planning Commission finds that the standards for a PUD review process are met. 4, The application has gone through the P D preliminary and final review process and the Planning Commission has recommende the final review to the City Council. Now THEREFORE BE IT RESOLVED, that based upon t e above findings of fact the application PUD03-02, is hereby recommended for approva subject to the fOl1owing conditions: 1. Approval ofa permit by the Rice Creek Watershed District. 2. A final utility plan shall be submitted a d approved by the City Engineer. 3.
