<br />c,~ <br /> <br />RESOLUTION No 03-076 <br />STATE OF MINNES TA <br />COUNTY OF RAMS Y <br />CITY OF NEW BRIG TON <br /> <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVAL F A PLANNED UNIT DEVELOPMENT (PUD) <br />FOR BRIGHTON VILLAGE PUD03-02; <br /> <br /> <br /> <br />WHEREAS, an application has been made by Kraus Anders n, Inc. for Engelsma Limited Partnership to <br />be considered for a Final PUD review by the City Co unci . <br /> <br />WHEREAS, the procedural history of the application is as fi 110ws: <br /> <br />1. An application for Final PUD Review, Sit Plan, and Final Plat was filed with the City <br />of New Brighton on August 3,2003. <br /> <br />2. The Planning Commission, pursuant to pu lished and mailed notices, held a public <br />hearing on August 19,2003 and an person present at the hearing were given an <br />opportunity to be heard. The Planning Co mission considered the plans and <br />recommended preliminary review approv I subject to conditions. <br /> <br />3. The City Council heard the request and a roved the preliminary plan on August 26, <br />2003. <br /> <br />4. An application for a Final PUD review an Final Plat was filed with the City of New <br />Brighton on October 3,2003. <br /> <br />5. The Planning Commission reviewed the nal plan on October 21,2003 and all persons <br />present were given an opportunity to be hard. The Planning Commission considered <br />the plans and recommended final review pproval subject to conditions. <br /> <br />6. The City Council heard the request and a proved the proposal with conditions. <br /> <br />; i <br /> <br />i ~ <br /> <br />\ ~ <br /> <br /> <br />WHEREAS, the Planning Commission makes the followi g Findings of Fact in respect to PUD03-02: <br /> <br />; : <br /> <br />1. The site is zoned B-3, General Business. <br /> <br />2. Under a Planned Unit Development St II approval process, increased density, height <br />limitations, and land uses are reviewed a d considered. <br /> <br />3. The Planning Commission finds that the standards for a PUD review process are met. <br /> <br />4, The application has gone through the P D preliminary and final review process and the <br />Planning Commission has recommende the final review to the City Council. <br /> <br />Now THEREFORE BE IT RESOLVED, that based upon t e above findings of fact the application <br />PUD03-02, is hereby recommended for approva subject to the fOl1owing conditions: <br /> <br />1. Approval ofa permit by the Rice Creek Watershed District. <br />2. A final utility plan shall be submitted a d approved by the City Engineer. <br />3.
