RESOLUTION No. 08-044 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF AN AMENDMENT TO RESOLU <br />ONS # <br />07-042 AND 07-081. <br />The City Council adopted Resolution 07-042 on May 8, 2007. <br />WHEREAS, a request has been made by Noun Wells on behalf of Manfred Niedernhoefi <br />to be <br />considered for an amendment to Resolutions 07-042 and 07-081 concerning an extensio <br />i of the <br />removal date of the single family home and to permit revisions to the approved landscape <br />I Ian. <br />WHEREAS, the procedural history of the application is as follows: <br />1. <br />The City Council adopted Resolution 07-042 on May 8, 2007. <br />2. <br />The City Council adopted Resolution 07-081 on July 24, 2007 <br />3. <br />The applicant submitted a letter requesting amendments to previous approvals on <br />pril 1, <br />2008 <br />4. <br />The City Council considered the request on April 22, 2008. <br />WHEREAS, the City Council makes the following Findings of Fact with respect to an <br />tending <br />approvals per Resolution 07-042 and 07-081: <br />1. <br />The Site Plan and Site Plan Amendment previously approved in Resolutions #07-042 <br />and <br />#07-81 outlines development of the site in compliance with the I-1 standards noted in <br />ection <br />6-060. <br />2. <br />The proposed amendments to Resolutions 07-042 and 07-081 do not have any impac <br />on the <br />approved Site Plan or any Industrial district standards. <br />3. <br />Additional time is necessary in order to remove the single family home, as the pro <br />ect has <br />already been delayed due to MnDOT, RCWD, and platting issues. <br />4. <br />The applicant has been working with the Public Safety Department to donate the hi <br />i ne for <br />fire training purposes. <br />5. <br />Landscape changes were necessary in order to comply with the Rice Creek W <br />shed <br />District standards. <br />6. <br />The City Forester finds the proposed landscape changes acceptable. <br />Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the requ t for <br />amendments to Resolutions #07-042 and #07-081 are hereby approved subject to the fo lowing <br />conditions: <br />1. Continued compliance with the conditions of Resolutions 07-042 and 07-081. <br />2. Removal of the single family home and associated accessory buildings at 2 3 Old <br />Highway 8 NW by October 1, 2008. Prior to issuance of a building ped it the <br />applicant must submit a financial guarantee in the form of a Letter of Credit r cash <br />escrow in the amount of $10,000 to ensure removal of the home. <br />3. A revised Landscape Plan is submitted at the time of building pemrit, implemenl4ng the <br />recommendations of the City Forester, as noted in the email correspondentdated <br />4/8/2008 and included in the Council Memo dated 4/15/2008. <br />1\C0UNCIL\REP0RTS\2008\Community Development\4-22-2008\Amendment to 07-042 & 07-081 (Cheetah Precision) - <br />1 <br />
