Director ofCommautyDevelopmeit Giant Feneliuus reported that aresolution was passed in February 2007, which resulted in a spacial legislation bill, included in the omntbus tax bill, which was vetoed by the Governor. The TIF 26 legislation was approved as part of a non-oontroveisid tax bill in March 2008. This allows the City to pool mcrement for TIF 26 for specific uses in the Northwest Quadrant projects. The additional resources available is estimated to be $6.8 million on a present value basis. Councilmember Doffing questioned how the funds would be applied, and how this would reduce the levy. Mr. Femelius directed council to a spreadsheet included in the staffreport, where abreakdown was presented. Councilmember Doffing questioned where the money would come from, if this option was not exercised. Mr. Femelius reported another option wouldbe to pool other districts. Councilmember Phillips questioned whetherthese funds were in excess ofrequirements for obligations. Mr. Femeliuus reported these as surplus funds. Councilmember Phillips requested clarification on an earlier statement reporting these funds being available at a later date. Councilmember Bauman also was under the undastandirig that finds would not be available unili12014. Mr. Lotter reported abrief financial report from the Finance Director may clear up any confusion. Councilmember Doffing stated her support, for the reason it allows the City to meet our obligations, without resorting to a levy increase. Motion by Councilmember Doffing, seconded by Councilmember Burg to adopt the attached resolution approving the Special Legislation for Tax Increment Financing (M District 26. Report No. 08- 118. ResohrtionNo.08-042. The City Planner, Janice Guridlwh directed council to the amended resolution. Councilmember Doffing read through key points of the resolution, and reported it was the decision ofthe Council that an educational facility in a heavy industrial zone would not be compatible. Councihneirrber Bauman requested that going forward, two resolutions would be prepared, one for approval and the other for use in the event of denial.
