IVAff ON <br />the city that works for you <br />Report Number <br />Agenda Section <br />Report Date <br />Council Meeting Date <br />0 REQUEST FOR COUNCIL CONSIDERATION <br />08-139 <br />VI -5 <br />April 16, 2008 <br />May 2, 2008 <br />ITEM DESCRIPTION: 180 -Day Extension of a Special Use Permit Approved per Resolution 07-082 <br />for Irondale High School Concerning Construction of a 16' 20' Equipment Shed. <br />DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this <br />Comments <br />Recommendation: To adopt the attached Resolution approving a 180 -day extension of a Special Use <br />Permit for Irondale High School to July 24, 2008. <br />Legislative History: July 17, 2007: The Planning Commission, pursuant to published and mailed <br />notices, held a public hearing and recommended approval of the request. <br />July 24, 2007: The City Council considered the requested Special Use Permit and adopted Resolution <br />07-082, approving the request as submitted. <br />Financial Impact: Not applicable <br />•Explanation: The applicant obtained a Special Use Permit on July 24, 2007. These approvals allowed <br />for construction of a 16' x 20' equipment shed near the ball fields at the east end of the property. This <br />property is zoned R — 1, Single Family Residential and the school use exists in this district through a <br />Special Use Permit. As such, any improvements to the property also require review and approval of a <br />Special Use Permit. <br />Zoning Code Section 8-250 states that a Special Use Permit shall expire 180 days from the date of <br />approval if a building permit is not obtained. The Council granted approval on July 24, 2007 and thus <br />the 180 days expired on January 24, 2008. The applicant has indicated that construction of the shed is <br />part of a class project, with that class only being offered in the second half of the year. Because the <br />original approval was granted after classes were dismissed for the summer, a class has yet to construct <br />the shed. However, the applicant has indicated that the shed is still needed and would request an <br />extension of the original approval. The applicant has provided a letter requesting that the extension be <br />granted retroactively to July 24, 2008, which would allow this semester's class to construct the shed <br />before the end of the school year. While technically the extension should have been requested prior to <br />the expiration, City staff has supported these requests so long as they do not exceed 180 days from the <br />original expiration and there are no changes to the project.
