Recitals. <br /> <br />1.01 The City has heretofore determined that acquisition of the real property <br />locat~d at 75 - 14th Street NW and 119 - 14th Street NW, New Brighton, Minnesota (the <br />"Property") owned by Butchers Spur Inc. (the "Company," formerly known as The <br />Mengelkoch Co.) is necessary for redevelopment and promotes the objectives outlined in <br />the tV10dified Development Program. <br /> <br />.' 1.02 The City is negotiating the terms of a Purchase Agreement with the Company <br />relating to the purchase of the Property. <br /> <br />1.03 The Company is concerned that if it and the City are unable to reach mutually <br />agre~able terms for voluntary acquisition of the Property by the City, the Company will lose <br />its nq>nconfirming use ofthe Property as a rendering plant and the value ofthe Property will <br />declime as a result. <br /> <br />Section 2. Findings. <br /> <br />2.01 The City intends to acquire the Property either through voluntary acquisition <br />or exercise of the City's power of eminent domain because acquisition of the Property is <br />necessary for redevelopment. <br />
