<br />, ' <br />I'; <br /> <br />; ~ <br /> <br />, . <br />, . <br />I <br />. ; <br />t <br />; <br /> <br />RESOLUTION No. 03-062 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING GP03~02, and LP03-07. <br /> <br />WHEREAS, an application for a General Development Plan Amendment and a Site Plan Review was <br />made by Finn Daniels on behalf of CU Mortgage Companies to amend the approved Main <br />Street Village General Development plan and to construct an addition onto 500 and 550 <br />Main Street; and, <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />, , 1. <br /> 2. <br /> 3. <br /> 4. <br /> 5. <br /> <br />An application was filed with the City of New Brighton on August 1,2003; <br />The Planning Commission held a public hearing on August 19,2003 and all present were <br />given the opportunity to be heard; <br />Citing design concerns with the site plan and fayade of the proposed structure, the Planning <br />Commission continued the public hearing. <br />The Planning Commission considered the application and revised plans at the September 16, <br />2003 meeting and recommended approval to the City Council with conditions; and, <br />The City Council heard the request and reviewed plans on September 23, 2003. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact: <br />i ! 1. the site is zoned B-4, Downtown Business and is controlled by a General Development Plan <br />as part of a Planned Unit Development; <br />2, An amended General Development Plan was approved by the City Council in June, 2001, <br />amended September 2002, and May, 2003. <br />3. The applicant has applied for a Minor Subdivision to combine lots 1 and 2, Main Street <br />Village 1 st Addition to New Brighton. <br />4. A Declaration of Covenants and deed restrictions is a required component of the approval <br />process for Lot 1 and 2, Main Street Village 1 st Addition to New Brighton; the Covenants <br />outline the types of uses allowed on each block of the Main Street Village development. <br />5. The proposed use is consistent with existing Covenants. <br />6. A new Declaration is required to be filed against the new combined lots of record. <br /> <br />, . BE IT FURTHER RESOLVED, the application GP03-02, and LP03-07 is hereby approved with the <br />following conditions: <br /> <br />1. Development and use of the property shall conform in all respects to the General <br />Development Plan approved June 26, 200 I and as amended by the Council August 29, <br />2002, <br /> <br />2. Developer shall add the amended General Development Plan to the declaration of <br />covenants and restrictions to assure development in accordance with the General <br />Development Plan and conditions imposed by the City. <br /> <br />3.
