<br />:: 7. <br />: 8. <br /> <br />;9. <br />I <br />I <br />i <br /> <br />'I::' <br /> <br />,~ <br /> <br />10. <br /> <br />The City Council finds the special use standards satisfied in Section 8-130. <br /> <br />The applicant is requesting a Type 4 Non-conforming Use Permit to construct a 720 square foot <br />garage. <br />Where Type 4 noneonformities are present and are proposed to continue, expansion of the existing <br />structure, construction of new structures, or resumption of use after discontinuance of use for six <br />or more months shall be allowed only upon permission of the City Council <br /> <br />As specified in Section 8460 (2) of the New Brighton Zoning Ordinance, no Type 4 <br />Nonconforming Use Permit shall be granted unless one or more of the following conditions are <br />met: <br /> <br />a. The total number of non conformities is reduced. <br />b. The impact of any nonconformities upon adjacent premises is reduced to the greatest <br />practical extent. <br />c. The extent of any nonconformity is reduced where practica1. <br /> <br />11. <br /> <br />The applicant is proposing to reduce the total number of accessory structures from three (3) to two <br />(2). <br />The City Council finds that the applicant meets the conditions of Section 8-460. <br /> <br />12. <br /> <br />BE tt FURTHER RESOLVED, the application NC 03-02 is hereby approved with the following condition: <br />! , <br /> <br />1. The applicant shall produce drawing of new building location to City Planner with elevations; Staff <br />shall determine if proposed plan is in conformance with the Zoning Code. <br /> <br />~.
