RESOLUTION NO. <br />08-056 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION ORDERING THE IMPROVEMENTS AND AUTHORIZING THE <br />PREPARATION OF PLANS AND SPECIFICATIONS FOR CITY PROJECT <br />07-5, NORTHWEST QUADRANT DUMP CLOSURE PLAN <br />WHEREAS, an initial Response Action Plan (RAP) for East Side for DSU's <br />mixed use development concept was submitted to the MPCA in Nov. 2005. The MPCA <br />approved this RAP, but had significant comments that led to negotiations with MPCA in <br />2006, and; <br />WHEREAS, an updated RAP was prepared for the remaining portions of the <br />Eastern Northwest Quadrant in Feb. 2008. A worksession with City Council on March <br />25, 2008 discussed this updated RAP. The MPCA approved the RAP on May 1, 2008 <br />(re -approved with Petroleum Brownfields on May 15, 2008, and; <br />WHEREAS, plans and specifications for this project will be prepared by Barr <br />Engineering to implement this updated RAP. This project consists of preparing a dump <br />closure plan for the Old Miller Dump located on the east side of Old Highway S. Old <br />Miller Dump contains approximately 800,000 cubic yards of waste that covers about 23 <br />acres, or about 60 percent of the redevelopment area. <br />NOW, THEREFORE LET IT BE RESOLVED, by the City Council of the City of <br />New Brighton: <br />1. Such improvement is hereby ordered as proposed in this Council Resolution. <br />2. The preparation of plans and specifications of City Project 07-5 are hereby <br />authorized. The plans shall include the following alternate bids: <br />a. The plans shall include an alternate bid to remove dump materials 200 <br />feet from Block A. <br />b.
