5. Section 2.2 D. The City's officers will be required to cooperate with St. Paul <br />after the Convention with respect to follow-up activities related to the <br />Convention, including, but not limited to, completing surveys, participating in <br />debriefings and participating in criminal or civil legal proceedings, if requested. <br />6. Section 3.2. The City should be aware that St. Paul's obligation to reimburse the <br />City for its costs or expenses is limited to the funds available in the security <br />subsidy that St. Paul will be receiving from the federal government and third <br />parties. In the event that St. Paul's expenses exceed the amount of the subsidy, <br />the funds will be distributed among the service providers in a ratio based on each <br />organization's contribution as a share of total contributions. According to St. Paul <br />and the League of Minnesota Cities, there is no reason at this time to believe that <br />the security subsidy will not be sufficient to fully reimburse the City. However, <br />the City should be aware that there is a possibility that it may not be fully <br />reimbursed or reimbursed at all. Also, the City should note that there will be no <br />compensation for the backfilling of positions due to the City's officers providing <br />security during the Convention. <br />7. Section 5.1. The City and St. Paul are required to agree on an amount for the <br />City's services to be provided that reimbursement is not to exceed. This amount <br />must be decided upon by June 30, 2008. Once that amount is agreed upon, the <br />City's reimbursement cannot exceed that amount, even if the City's actual <br />expenses exceed that amount. <br />• 8. Section 5.2.1. The City should be aware that it will not be reimbursed by St. Paul <br />for any of its services until after the Convention is over. <br />9. Section 7.4. The City is required to supply St. Paul with supporting <br />documentation and business records related to the services performed by the City <br />pursuant to the Agreement. The City also must maintain all business records <br />related to the services for at least six years. <br />B. As you know, the League of Minnesota Cities has some concerns about the JPA. <br />The League has raised the following issues: <br />1. Section 11.1. The League of Minnesota Cities has a concern that the insurance <br />coverage that is to be provided by the Host Committee on behalf of St. Paul might <br />not be sufficient. Due to the fact that there will probably be many protesters at <br />the Convention, there is an increased possibility of violence, which means that <br />there could be many claims against police officers. These claims could include <br />possible civil rights claims which could exceed the $10,000,000 liability limit of <br />the Host Committee insurance policy fairly quickly because these types of claims <br />are outside of the statutory tort liability limits. The League has been told by St. <br />Paul that the claims from previous conventions have never surpassed $10,000,000 <br />which is hopefully a good indication that the limit will be sufficient. In the event <br />• that the liability limit of the insurance policy is exceeded, the City's LMCIT <br />coverage would cover the City.
