4. The League of Minnesota Cities has also commented that the Agreement does not <br />address damage to equipment. John Kelly has informed me that the City's <br />assisting officers will not be using any equipment (other than minimal equipment <br />such as weapons and uniforms). They will not be using any vehicles or other <br />expensive equipment. <br />Conclusion <br />The League of Minnesota Cities and St. Paul met on May 29, 2008 in an attempt to <br />address the League's concerns. However, based on the June 11, 2008 memorandum that was <br />issued by the League last week, you will see that the League still has essentially the same issues <br />with the Joint Powers Agreement. St. Paul has responded to this memorandum by stating that <br />the JPA is still non-negotiable and no terms will be changed. <br />Based on the information that I have received from St. Paul, I am comfortable with the <br />terms of the Joint Powers Agreement. However, this is based on the representations made by St. <br />Paul that officers from the assisting cities will not be performing any high-risk type of work <br />(such as dealing with the protestors). If you review the League memorandum, you will see that <br />the insurance coverage issues mainly arise when high-risk work is involved. Therefore, I think <br />that it is important that the City be aware of the type of work St. Paul will be assigning to its <br />officers. <br />I think that the City Council can approve the Joint Powers Agreement, but if you have not <br />. already done so, you should find out the type of work that the officers will be performing at the <br />Convention. <br />• <br />335193v1 S1S NE136-21 4 <br />
