• RESOLUTION NO. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT AND <br />NONCONFORMING USE PERMIT. <br />WHEREAS, an application has been made by Michael Skiba to permit construction of a deck on the <br />south side of the home and detached garage addition whereby the total square footage will <br />exceed 624 square feet on property located at 1121 10th Street NW. <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit and Nonconforming Use Permit were received on <br />May 30, 2008 <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on June 17, 2008 and all present were given a chance to freely speak at the hearing. <br />3. The Planning Commission recommended approval on June 17, 2008. <br />4. The City Council considered the request on June 24, 2008. <br />WHEREAS, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (SP2008-011) and Nonconforming Use Permit (NC2008-003): <br />1. The property is zoned R-1, Single Family Residential. <br />2. The property is guided in the Comprehensive Plan for Low Density Residential. <br />3. The property is legally described as follows: <br />THE NORTH 327.21 FEET OF THE WEST 298.1 FEET OF THE NE '/4 OF THE NW '/4 <br />OF SECTION 29, TOWNSHIP 30, RANGE 23, RAMSEY COUNTY, MINNESOTA, <br />EXCEPT THE WEST 148.10 FEET THEREOF AND EXCEPT THE EAST 75 FEET OF <br />THE NORTH 180.105 FEET THEREOF. <br />4. The applicant has proposed to construct an addition to the existing detached garage whereby <br />its total square footage will exceed 624 SF. <br />5. The proposal was considered in accordance with the Special Use standards of Zoning Code <br />Section 4-530 (1) (K), which requires that the garage meet the following conditions: <br />a. Roof and exterior color and material must be consistent and complimentary with the <br />principal structure. <br />b. If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />c. No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />6. Further, the proposal was reviewed in accordance with the following Special Use Permit <br />conditions of Zoning Code Section 8-130: <br />a.
