RESOLUTION NO. <br />08-058 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT AND <br />✓LING USE PERMrr. <br />7HEAS, an application has been made by Michael Skiba to permit construction of a deck on <br />the uth side of the home and detached garage addition whereby the total square footage will <br />exceod 624 square feet on property located at 1121 10`" Street NW. <br />1HEI I PIAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit and Nonconforming Use Permit were received on <br />ay 30, 2008 <br />2. Tie Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on June 17, 2008 and all present were given a chance to freely speak at the hearing. <br />3. Tie Planning Commission recommended approval on June 17, 2008. <br />4. e City Council considered the request on June 24, 2008. <br />fHEI EAS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Special Use Permit (SP2008-011) and Nonconforming Use Permit (NC2008-003): <br />1. e property is zoned R-1, Single Family Residential. <br />2. e property is guided in the Comprehensive Plan for Low Density Residential. <br />3. e property is legally described as follows: <br />E NORTH 327.21 FEET OF THE WEST 298.1 FEET OF THE NE '/ OF THE NW '/ <br />OF SECTION 29, TOWNSHIP 30, RANGE 23, RAMSEY COUNTY, MINNESOTA, <br />CEPT THE WEST 148.10 FEET THEREOF AND EXCEPT THE EAST 75 FEET OF <br />E NORTH 180.105 FEET THEREOF. <br />4. a applicant has proposed to construct an addition to the existing detached garage whereby <br />i total square footage will exceed 624 SF. <br />5. The proposal was considered in accordance with the Special Use standards of Zoning Code <br />11 <br />ction 4-530 (1) (K), which requires that the garage meet the following conditions: <br />Roof and exterior color and material must be consistent and complimentary with the <br />principal structure. <br />If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />6. prther, the proposal was reviewed in accordance with the following Special Use Permit <br />nditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />Development\6-24-2008\NC2008-003, SP2008-011 (Skdba) - RESOLUTION.doc 1 <br />
