RESOLUTION NO. <br />08-059 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />✓HE14AS, an application has been made by Dennis Schwab to permit construction of an addition <br />to existing attached garage whereby the total square footage would exceed 624 s.f. at <br />app ximately 660 SF at 1974 Rockstone Lane, and <br />(HEI AS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on May 30, 2008. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />> i June 17, 2008 and all present were given a chance to freely speak at the hearing. <br />3. � c Planning Commission recommended approval on June 17, 2008. <br />4. e City Council considered the request on June 24, 2008. <br />S, the Planning Commission and City Council make the following Findings of Fact with <br />to the Special Use Permit (SP2008-010): <br />property is zoned R-1, Single Family Residential. <br />2. J�e property is guided in the Comprehensive Plan for Low Density Residential. <br />3. e property is legally described as follows: <br />j Lot 21, Block 3, BRITTANY BEACH, Ramsey County, Minnesota <br />4.e applicant has proposed to construct an addition to the existing attached garage whereby <br />total square footage would exceed 624 square feet. <br />5.luires <br />a proposal was considered in accordance with Zoning Code Section 4-530 (1) (E) which <br />approval of a Special Use Permit for any accessory building in excess of 624 square <br />6. a proposal was considered in accordance with the Special Use Permit standards of Zoning <br />de Section 4-530 (1) (K) which requires that the garage meet the following conditions: <br />a.! Roof and exterior color and material must be consistent and complimentary with the <br />i j principal structure. <br />If deemed necessary by the City Council, landscape screening shall be provided to lessen <br />visual impact from adjacent properties. <br />No commercial or home occupation activity shall be conducted within the accessory <br />building. <br />le proposal was reviewed in accordance with the following Special Use Permit conditions <br />Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />Development\6-24-20OMP2008-010 (Schwab) - RESOLUTION.doc <br />
