RESOLUTION NO. <br />08-062 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />1HE AS, an application has been made by Business Data Record Services to permit erection of a <br />50' WIFI tower on the roof of the existing building at 201 9th AVE SW, and <br />✓HEF As, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on May 29, 2008. <br />2. Tie Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on June 17, 2008 and all present were given a chance to freely speak at the hearing. <br />3. 1e Planning Commission recommended approval on June 17, 2008. <br />4. J e City Council considered the request on June 24, 2008. <br />JHEI As, the Planning Commission and City Council make the following Findings of Fact with <br />resp v to the Special Use Permit (SP2008-012): <br />1. e property is zoned I -1, Light Industrial. <br />2. e property is guided in the Comprehensive Plan for Light Industrial <br />3. e property is legally described in attached Exhibit A. <br />4. ie applicant has proposed to erect wireless telecommunication antenna/tower in excess of <br />in height whereby a Special Use Permit must be obtained. <br />5. a proposal was reviewed in accordance with the following standards of Section 4-600 <br />All towers and antennae shall have setbacks equal to or greater than the height of the <br />proposed structure. <br />The distance of any guy anchorage or similar device shall be at least ten feet from any <br />property line. <br />Suitable protective anti -climb fencing and a landscape planting screen shall be provided <br />and maintained around the structure and accessory attachments. <br />The applicant shall present documentation of the possession of any required license by <br />any Federal, State, or local agency. <br />No structure shall be in excess of a height equal to the distance from the base of the <br />structure to the nearest overhead electrical power line which serves more than 1 dwelling <br />or place of business, less five feet. <br />Only one such structure exceeding the district height limitations shall exist at any one <br />time on any residentially zoned and used lot or parcel. <br />Application for the permit must include construction drawings showing proposed method <br />of installation, structural engineering analysis, and a site plan depicting structures and <br />plantings on the property and all adjacent properties. At the request of the administrative <br />authority, documentation of a maintenance program may be required. <br />If any modifications are made to the structure, the City shall have the authority to require <br />proof that the addition, change, or modification is in conformity with the permit and the <br />Development%6-24-2008%SP2008-009 (Record Data Services) - RESOLUTION.doc <br />
