STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />ORDINANCE NO. 763 <br />ORDINANCE RELATING TO STORM WATER UTILITY CHAPTER TO <br />DE POST CONSTRUCTION INSPECTIONS AND PROVIDE CREDITS FOR <br />RAIN GARDENS <br />COUNCIL OF THE CITY OF NEW BRIGHTON DOES ORDAIN AS <br />Section 1. The New Brighton City Code of Ordinances is amended by amending <br />1, Section 31-2 and 31-4 as follows: <br />Sec. $Il -2. Definitions. <br />The Hefinitions of this Section shall apply when these words and phrases are used in this <br />(1) rmwater Utility Rate. The rate for the Stormwater Utility is the rate developed for each <br />land lassification pursuant to City regulations. This utility rate shall be established by <br />(2) Moormwater Utility Fee. The fee for the Stormwater Utility is the charge developed for each <br />parct I and is equal to the Stormwater Utility rate multiplied by the parcel area, in acres. In the <br />case f the single and two family residential land classification, a standard lot size of 1/3 acre <br />will be used to calculate the stormwater utility fee regardless of the actual lot size. <br />(3) .Tormwater Utility Budget. The Stormwater Utility budget is the estimated annual <br />expek Jitures for planning, reconstruction, maintenance, and meeting all State and Federal laws, <br />rules and regulations, pertaining to storm water management of the City's storm sewer system. <br />This Ludget shall be established during the annual budgeting process by the City Council. (Ord. <br />No. 608, 12-13-94; Code of 2001) <br />Sec.:M-4. Adjustment of Fees. <br />Feesay be adjusted in accordance with the conditions cited in this Section. In the case of an <br />adju � cnt under Section 31-4(3-6) the property owner shall provide the information required to <br />justi an adjustment. The adjustments allowable in Section 31-4(3-5) will not be made to single <br />
