<br />. <br /> <br />RESOLUTION No. 03-049 <br />ST ATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTJONMAKING FINDINGS OF FACT AND APPROVING OF PUD03-02. <br /> <br />WHEREAS, an application has been made by Kraus Anderson for Engelsma Limited Partnership for a <br />Planned Unit Development to redevelop Brighton Village Shopping Center. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />I. An application for PUD, Site Plan, and Preliminary Plat was filed with the City of New <br />Brighton on August 1,2003. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on <br />August 19,2003 and all persons present at the hearing were given an opportunity to be heard. <br />The Planning Commission considered the plans and recommended preliminary review approval <br />subject to conditions. <br /> <br />3. The City Council considered the Planning Commission's recommendation and voted on August <br />26, 2003 to approve the applications. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />PUD03-02 : <br /> <br />1. The site is zoned B-3, General Business. <br /> <br />2. Under a Planned Unit Development preliminary Step I approval process, increased <br />density, height limitations, and land uses are reviewed and considered. <br /> <br />3. The Planning Commission finds that the standards for a POO Step I process are met. <br /> <br />4. The Planning Commission finds that the submitted site plan follow the guidelines <br />approved by the Council within the Brighton Village Planning and Design Standards. <br /> <br />5. The application has gone through the PUD Review Process and the Planning Commission <br />has recommended the Preliminary Review to the City Council. <br /> <br />BE IT FURTHER RESOLVED, that based upon the above findings offact the application PUD03-02 is <br />hereby approved subject to the following conditions: <br /> <br />1. Approval of a permit by the Rice Creek Watershed District. <br /> <br />2. Light plans for the proposal are submitted to the City detailing materials, height and <br />supportive data to be approved by the Council. <br /> <br />3. A final grading plan shall be submitted and approved by the City Engineer. <br /> <br />4. Complete landscape plans are submitted, subject to review and approval of the City <br />Planner. <br /> <br />5. A final plat is submitted with final PUD to the City Council. <br /> <br />6.
