<br />" <br />'I, <br />I*, <br />rr <br /> <br /><";. <br /> <br />" <br />!i <br />Ii <br />II <br />!i <br />II <br />Ii <br />II <br />Ii <br /> <br />tSOLUTION MAKING FINDINGS OF FACT AND MPROVlNG SP 03-03. <br /> <br />JiTHEREAS, an application for a special use permit has been made by Ms. Janice Chock to construct a 720 <br />{'Ir square foot garage located at 857 3rd Avenue NW; and <br />! <br />, HEREAS, the procedural history of the application is as follows: <br />IiI. An application for a special use permit was filed with the City of New Brighton on April <br />Ii 25,2003. <br />)! 2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />11 on May 20, 2003 and all present were given a chance to freely speak at the hearing; <br />II 3. The City Council heard the request on May 27,2003; and, <br />II <br />~OW THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact: <br />11 1. The subject site is zoned R-1, Single Family Residential. <br /> <br />Ii 2. The applicant is requesting a Special Use Permit to construct a 720 square foot garage. <br />Ii 3. Garages larger than 400 ft.2in size are required to obtain a Special Use Permit. <br />I; <br />: i 4. As specified in Section 8~ 130 of the New Brighton Zoning Ordinance, no special use shall <br />!! be recommended by the Planning Commission unless such shall find: <br />I' <br />;; a. That the establishment, maintenance, or operations of the special use will not <br />H be detrimental to or endanger the public health, safety, morals, comfort of <br />'i general public. <br />I' <br />Ii b. That the special use will not be injurious to the use and enjoyment of other <br />I i property in the immediate vicinity for the purposes already permitted, nor <br />i: substantially diminish and impair property values within the neighborhood. <br />II. <br />il c. That the establishment of the special use will not impede the normal and <br />ii <br />:! orderly development and improvement of the surrounding property for uses <br />:! permitted in the district. <br />i' d. That adequate utilities, access roads, drainage and/or necessary facilities have <br />! j been or are being provided. <br />Ii e. That the special use shall, in all other respects, conform to the applicable <br />q regulations of the district in which it located. <br />I 5.
