<br />1- II <br />L <br />I' <br />II <br />II <br />II <br />11 <br />II <br />II <br />!I <br />,I <br /> <br />II RESOLUTION MAKING FINDINGS OF FACT AND ApPROVING of SP 03-04. <br /> <br />1.,1,', <br />',' <br />ill <br />!i <br /> <br />"....; <br /> <br />:' <br /> <br />RESOLUTION No. 03-037 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />WHEREAS, an application for a special use permit has been made by Mr. Aaron Suer to <br />construct a 720 square foot garage located at 1965 County Road E; and <br /> <br />j, <br />II WHEREAS, the procedural history of the application is as follows: <br />il <br />II <br />Il <br />I' <br />I <br />, <br />I <br />I <br />II <br />I' <br />:1 <br />Iii <br />! <br />11 <br />Ii <br />'I <br />Ii <br />H <br />Ii <br />P <br />Ii <br />ii <br />ii <br />I' <br />i <br />I <br />I <br />i <br /> <br />1. <br /> <br />An application for a special use permit was filed with the City of New Brighton on Apri118, <br />2003. <br />The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 20, 2003 and all present were given a chance to freely speak at the hearing; <br />The Commission found that the Zoning standards were met and recommended approval to <br />the City Council; and, <br />The City Council heard the request on May 27,2003. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to SP 03-04: <br /> <br />1. <br />2. <br />3. <br />4. <br /> <br />The subject site is zoned R-1, Single Family Residential. <br /> <br />The applicant is requesting a Special Use Permit to construct a 720 square foot garage. <br />Garages larger than 400 ft.z in size are required to obtain a Special Use Permit. <br />As specified in Section 8-130 ofthe New Brighton Zoning Ordinance, no special use shaH <br />be approved by the City Council unless such shall find: <br /> <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general <br />public. <br />b. That the special use will not be injurious to the use and enjoyment of other <br />property in the immediate vicinity for the purposes already permitted, nor <br />substantiaHy diminish and impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for uses <br />permitted in the district. <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have <br />been or are being provided. <br />e. That the special use shall, in all other respects, conform to the applicable <br />regulations of the district in which it located. <br /> <br />5.
