That an application for Variance, VN-212 was filed <br /> I <br /> with the City of New Brighton on October 1, 1979. <br /> I <br /> I 2. That such application was reviewed by the New I <br /> I I <br /> Brighton Planning Commission Board of Review on <br /> I November 20, 1979. <br /> I 3. That the City Council, pursuant to published and <br /> II mailed notices, held a public hearing on October 23, I <br /> II 1979 and continued on November 27, 1979, all ! <br /> II person's present at the hearing were given an <br /> opportunity to be heard. <br /> I, ! <br /> II 4. The written comments and analysis of the City staff, <br /> the Planning Commission minutes and recommendations I <br /> were considered. <br /> I I <br /> I NOW THEREFORE BE IT RESOLVED, That the New Brighton 1 <br /> , I <br /> , Ci ty Counci 1 makes the following Findings of Fact in respect I <br /> I I <br /> I to VN-212: <br /> I <br /> l. That the site is located in a 1-2, Heavy Industrial I <br /> 1 <br /> zoning district. I <br /> 2 . That the site is unique in that it is enclosed on all <br /> sides by public street. <br /> i <br /> ! 3. That a six foot fence is necessary for security and j <br /> i a hardship would result if the zoning code was 1 <br /> I , <br /> , <br /> literally enforced only allowing the applicant a I <br /> fence of 3~ feet in height. I <br /> I <br /> I <br /> I I <br /> I 4. That the fence is a chain link fence which will I <br /> I not impair the visibility of persons traveling <br /> I <br /> on adjacent public streets. i <br /> 5. That the proposed fence will be setback on the I <br /> inside of the berm and landscaping and therefore <br /> I will not create an appearance that would adversely I <br /> affect adjacent property owners and would be <br /> consistent with similar security fences in that I <br /> area. <br /> I <br /> , <br /> I <br /> I <br /> I <br />
