<br />- ~. : <br /> " <br /> I <br />.- <br /> RESOLUTION NO. 2169 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION I <br /> FOR A NON-CONFORMING USE PERMIT NC-37 UNDER CERTAIN CONDITIONS I <br /> I <br /> WHEREAS an application for a non-conforming use permit I <br /> i <br /> NC~37 has been made by Dennis Schill to permit the re-use of I <br /> I <br /> property having Type IV non-conformities, located at 2190 I <br /> S i 1 ve r:,Lake Road, and <br /> ! <br /> WHEREAS, the procedural history of the application is as I <br /> follows: I <br /> i <br /> l. That an application for a non-conforming use permit I <br /> NC-37 was filed with the City of New Brighton on I <br /> February 12, 1979. <br /> I <br /> I <br /> 2. That such application was reviewed by the New Brightonl <br /> Planning Commission Board of Review on February 12, ! <br /> 1979. ! <br /> 3 . That the City Council, pursuant to published and I <br /> I <br /> mailed notices, held a public hearing on February 27, <br /> ! <br /> 1979, all person's present at the hearing were given ! <br /> I <br /> an opportunity to be heard. <br /> i <br /> j <br /> 4. The written comments and analysis of the City staff, I <br /> I <br /> the Planning Commission minutes and recommendations i <br /> were considered. i <br /> 1 <br /> I <br /> I <br /> NOW THEREFORE BE IT RESOLVED, that the New Brighton City I <br /> I <br /> Council makes the following Findings of Fact in respect to I <br /> i <br /> NC-37. I <br /> I <br /> i <br /> I <br /> l. That the following Type IV non-conformities exist on I <br /> I <br /> the property: ~ <br /> i <br /> j <br /> ! <br /> A. Less than required front yard landscaping. A I <br /> 30 foot landscaped front yard is required. I <br /> I <br /> I <br /> B.
