I r ..., " ~ . , '~ II'~ RESOLUTION NO 2258 II STATE OF MINNESOTA COUNTY OF RAMSEY CITY OF NEW BRIGHTON I RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VACATION OF THE CITY OF ,~EW BRIGHTON1S INTEREST IN THE PRIVATE DRIVE LOCATED WESY OF SILVER LAKE ROAD AND EAST OF INNSBRUCK DRIVE h II WHEREAS, The City Council has been petitioned to vacate II its interest in the private drive by Keith Harstad, the owner ! ~ of the adjoining properties, pursuant to MN Statutes. II II WHEREAS, The procedural history of the application is as I follows: II l. That the adjacent property owner requested the II vacation. II 2 . That the City Council, pursuant to published and mailed notices, held a public hearing on October 23, 1979, all person's present at the hearing were given II an opportunity to be heard. 'I I 3. The written comments and analysis of the City staff I' were considered. J II \1 NOW THEREFORE BE IT RESOLVED, That the New Brighton City ! 'I Council makes the following Findings of Fact in respect to II the proposed vacation: I' II That the City was granted the easement on the private II l. I drive to provide access from Silver Lake Road to a development in the City of Fridley. I 2. That the City has constructed a street connecting I Palmer Drive and Innsbruck Drive which provides said development in the City of Fridley with access from I Silver Lake Road, thereby eliminating the need for a connection provided by the private drive. I 3. That the property owner on both sides of the drive I has requested the vacation. I 4. That the vacation will not interfere with the City's I provision of services to the adjoining properties. BE IT FURTHER RESOLVED, That the City Council of the City I of New Brighton hereby vacates the following described private road easement: An easement for road purposes over a strip of land 66 ft. I ~ in width located in the N ~ of the SW ~ of Section 19, I I. Township 30, Range 23, Ramsey County, MN. The centerline of which is described as follows: Commencing at the SE II corner of the S ~ of the N ~ of the NE ~ of the SW ~ of said Section 19; thence N along the E side of the SW ~ of I' said Section 19 on an assumed bearing of N degrees 181 04" J E for a distance of 33 ft. to the actual point of beginn- II I! ing of the centerline to be described; thence N. 89 degrees 591 33" Wi. parallel with the S. line of said N. !I ~ of the SW ~ for a distance of 1369.17 ft. thence on a J ~ , ~ H tangential curve to the left with a radius of 3311.58 ft. n !I for a distance of 399.51 ft.:; the n c e S. 83 degrees 05 I 43" I' W. tangent to last described curve for a distance of ,I , I 470.91 ft. more or less to a point on the W. line of the I I SW ~ of said Section 19, said point being 705 ft. S . as I measured along said W. line, from the NW corner of SW ~ of said Section 19 and there terminating. Except that I portion dedicated for road purposes by the Innsbruck I I North Plat.
