<br /> I <br /> r <br />..., " ~ . , <br />'~ II'~ RESOLUTION NO 2258 <br />II <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> I RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VACATION OF <br /> THE CITY OF ,~EW BRIGHTON1S INTEREST IN THE PRIVATE DRIVE <br /> LOCATED WESY OF SILVER LAKE ROAD AND EAST OF INNSBRUCK DRIVE <br />h <br />II WHEREAS, The City Council has been petitioned to vacate <br />II its interest in the private drive by Keith Harstad, the owner <br />! ~ of the adjoining properties, pursuant to MN Statutes. <br />II <br />II WHEREAS, The procedural history of the application is as <br /> I <br /> follows: <br />II l. That the adjacent property owner requested the <br />II vacation. <br />II 2 . That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on October 23, <br /> 1979, all person's present at the hearing were given <br />II an opportunity to be heard. <br />'I <br />I 3. The written comments and analysis of the City staff <br />I' were considered. <br />J <br />II <br />\1 NOW THEREFORE BE IT RESOLVED, That the New Brighton City ! <br />'I Council makes the following Findings of Fact in respect to <br />II <br /> the proposed vacation: <br />I' <br />II That the City was granted the easement on the private <br />II l. <br />I drive to provide access from Silver Lake Road to a <br /> development in the City of Fridley. <br />I 2. That the City has constructed a street connecting <br />I Palmer Drive and Innsbruck Drive which provides said <br /> development in the City of Fridley with access from <br />I Silver Lake Road, thereby eliminating the need for a <br /> connection provided by the private drive. <br />I 3. That the property owner on both sides of the drive I <br /> has requested the vacation. I <br /> 4. That the vacation will not interfere with the City's I <br /> provision of services to the adjoining properties. <br /> BE IT FURTHER RESOLVED, That the City Council of the City <br />I of New Brighton hereby vacates the following described private <br /> road easement: <br /> An easement for road purposes over a strip of land 66 ft. <br />I ~ <br /> in width located in the N ~ of the SW ~ of Section 19, I <br />I. Township 30, Range 23, Ramsey County, MN. The centerline <br /> of which is described as follows: Commencing at the SE <br />II corner of the S ~ of the N ~ of the NE ~ of the SW ~ of <br /> said Section 19; thence N along the E side of the SW ~ of <br />I' said Section 19 on an assumed bearing of N degrees 181 04" <br />J E for a distance of 33 ft. to the actual point of beginn- <br />II <br />I! ing of the centerline to be described; thence N. 89 <br /> degrees 591 33" Wi. parallel with the S. line of said N. <br />!I ~ of the SW ~ for a distance of 1369.17 ft. thence on a <br />J ~ <br />, ~ <br />H tangential curve to the left with a radius of 3311.58 ft. <br />n <br />!I for a distance of 399.51 ft.:; the n c e S. 83 degrees 05 I 43" <br />I' W. tangent to last described curve for a distance of <br />,I , <br /> I 470.91 ft. more or less to a point on the W. line of the I <br /> I SW ~ of said Section 19, said point being 705 ft. S . as I <br /> measured along said W. line, from the NW corner of SW ~ <br /> of said Section 19 and there terminating.
