<br /> " <br />. r r,': <br /> -:i "- <br />~'. -~ 40.. -.., <br /> RESOLUTION NO. 2256 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION FOR <br /> NON-CONFORMING USE PERMIT, NC-42 <br /> WHEREAS, An application for a non-conforming use permit <br /> entitled NC-42 has been made by Griffis Inc. to permit the <br /> construction of an industrial building on a site with Type IV <br /> non-conformities. <br /> WHEREAS, The procedural history of the application is as <br /> follows: <br /> l. That an application for a non-conforming use permit, <br /> NC-42 was filed with the city of New Brighton on <br /> 12, 1979. <br /> 2. That such application was reviewed by the New Brighton <br /> Planning Cbmmission Board of Review on September 18, 197 <br /> 3. That the City Council, pursuant to published and mailed <br /> notices, held a public hearing on October 9, 1979, all <br /> person's present at the hearing were given an opportunity <br /> to be heard. <br /> 4. The written comments and analysis of the City staff, the <br /> Planning Commission minutes and recommendations were <br /> considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City Coun~il <br /> makes the following Findings of Fact in respect to NC-42: <br /> l. That the site has the following existing Type IV non- <br /> conformities: <br /> a. Front yard parking on a site in an industrial district. <br /> b. Lack of a dustless surface on driving areas and <br /> storage areas. <br /> c. Driveways exceed 36 feet in width. <br /> d. All outside storage is not screened from the public <br /> right-of-way. <br /> e. Equipment stored that exceeds 6 feet in height is <br /> not setback as required. <br /> f. Lack of concrete curbing along the driveways in the <br /> front yard. <br /> g. That the front and side yard setbacks are less than <br /> required. <br /> 2. That the applicant has addressed the non-conformities <br /> by proposing to install landscaping, concrete curbing, <br /> pave the driving and parking areas in the front yard, <br /> and reduce the number of front yard parking spaces. <br /> 3. That applicant does not intend on eliminating all the <br /> existing non-conformities because the general operation <br /> of the business restricts the amount of landscaping in <br /> the front yard. <br />
