I <br /> I, I <br /> d <br /> ;, <br /> p WHEREAS, The procedural history of the application is as <br /> i <br /> lj <br /> I: follows: <br /> Ii I <br /> it l. That an application for a non-conforming use permit I <br /> t! NC-40 was filed with the City of New Brighton on <br /> :1 September 4, 1979. j <br /> 2 . That such application was reviewed by the New Brighton. <br /> \,' Planning Commission Board of Review on September 18, <br /> , <br /> i 1979. <br /> i' 3. That the City Council, pursuant to published and <br /> i <br /> n mailed notices, held a public hearing on September 25, <br /> I: ~ <br /> 1979, all person's present at the hearing were given I <br /> n an opportunity to be heard. <br /> 1;1 4. The written comments and analysis of the City staff, <br /> H the Planning Commission minutes and recommendations <br /> n <br /> H were considered. <br /> !; I <br /> " <br /> il <br /> Ii NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> I <br /> Council makes the following Findings of Fact in respect to I <br /> il NC-40. I <br /> ;1 <br /> 'i. l. That the site has the following Type IV non- <br /> ,I conformities: <br /> I', <br /> 'I <br /> II Lack of concrete curbing; ! <br /> L a . <br /> Ii b . Front yard parking in an industrial site; <br /> u <br /> !\ c . Driveways in excess of 36 feet in width; and <br /> n <br /> 'I d. More than the permitted 2 driveways. <br /> :1 2. That the site and landscape plan indicate that the I <br /> ii <br /> ,,! applicant is proposing to reduce the number and impact <br /> Ij <br /> 'I of the existing non-conformities. <br /> H <br /> ii 3. That the existing landscaping in the front yard well <br /> II exceeds the area normally required for landscaping. <br /> H <br /> II 4. That the front yard parking is screened from the <br /> Ii <br /> II public right-of-way where practical. <br /> I! <br /> Ii BE IT FURTHER RESOLVED, That the application for NC-40 is <br /> hereby approved subject to the following conditions: <br /> !j , <br /> 1:, l. That the applicant install concrete curbing on the i <br /> ,,! <br /> i: southern portion of the driveway in the southeast i <br /> 11 1 <br /> corner of the property which would enclose the I <br /> :1 proposed landscape area and said landscaped area will <br /> I have the appropriate plantings to screen the remaining <br /> g <br /> II parking from the public right-of-way.
