<br /> ~ t -" <br /> \ <br /> ~ <br /> ... <br /> RESOLUTION NO 2244 <br /> STATE OF MINNESOTA <br /> STATE OF MINNESOTA <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR VARIANCE, VN-210 <br /> WHEREAS, An application for a wariance entitled VN-210 <br /> has been made by Charles Bergman, 299 Oakwood Drive to allow <br /> a fence 10 feet in height in the front and side yard of a <br /> residential site. <br /> WHEREAS, The procedural history of the application is as <br /> follows: <br /> l. That an application for Variance, VN-210 was filed <br /> with the City of New Brighton on July 13, 1979. <br /> 2. That such application was reviewed by the New Brighton <br /> Planning Commission Board of Review on August 22, 1979. <br /> 3. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on September 11, <br /> 1979, all persons's present at the hearing were given <br /> an opportunity to be heard. <br /> 4. The written comments and analysis of the City staff, <br /> the Planning Commission minutes and recommendations <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> VN-210: <br /> l. That the applicant has not obstructed vision by <br /> using screening material in the fence; <br /> 2. That the applicant has maintained the boulevard; <br /> 3. That the fence has not advers~ly affected traffic <br /> flow in that area; <br /> 4. That the fence provides maximum usage of the existing <br /> concrete pad; <br /> 5 . That the fence provides safety to those person's <br /> using the concrete pad; <br /> 6 . That the fence does not have a substantial negative <br /> impact on adjacent properties. <br /> BE IT FURTHER RESOLVED, That the application for <br /> VN-210 is hereby approved subject to the following conditions: <br /> ~ <br />
