";'" \ <br /> I <br /> I <br /> RESOLUTION NO 2236 A <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR VARIANCE, VN-209 <br /> I <br /> WHEREAS, An application for a Variance entitled VN-209 <br /> has been made by Belair Builders to permit less than the <br /> required number of parking spaces, front yard parking, lack of <br /> concrete curbing and lack of landscaping in the front yard of <br /> an industrial site. <br /> WHEREAS, The procedural history of the application is as <br /> follows: <br /> I l. That an application for Variance, VN-209 was filed <br /> with the City of New Brighton on August 8, 1979. <br /> 2. That such application was reviewed by the New <br /> Brighton Planning Commission Board of Review on <br /> August 22, 1979. <br /> 3. That the City Council, pursuant to published and I <br /> mailed notices, held a public hearing on August 28, I <br /> 1979, all person's present at the hearing were given <br /> an opportunity to be heard. <br /> 4. The written comments and analysis of the City staff, <br /> the Planning Commission minutes and recommendations <br /> were considered. I <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City I <br /> Council makes the following Findings of Fact in respect to <br /> I VN-209: <br /> l. That the elimination of parking in the front yard <br /> of the easterly site would be a harship in terms <br /> I of providing an adequate number of parking spaces. <br /> I 2. That concrete curbing along the driveway and <br /> I parking area for the eastern site would restri~t <br /> to some degree the shared use of the parking area. <br /> I 3. That the required front yard landscaping would <br /> eliminate parking spaces that are needed for the <br /> Ii general operation of the businesses on these parcels. <br /> ~ <br /> i <br /> ! 4. That the applicant under NC-38 has done everything ! <br /> practical to address the existing Type IV non- <br /> I conformities on the site. <br /> BE IT FURTHER RESOLVED, That the application VN-209 is <br /> hereby approved subject to the following conditions: <br /> l. That the applicant provide deed restrictions with <br /> the provision for shared or common parking areas; <br /> and <br /> 2 . That the applicant provide a private sanitary sewer <br /> easement on the western property; and <br /> 3. That the applicant provide signing in the front yard <br /> of parcel A to indicate short term customer parking <br /> only to indicate the availability of parking in the <br /> rear of the building and that the applicant make <br /> parking spaces available in the fenced in area of <br /> the site; and <br /> I <br />
