<br /> ..... , ~ I <br /> ' - <br /> ~ <br /> ~ <br /> .. ~ I <br /> RESOLUTION NO 2230 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> I RESOLUTION MAKING FINDINGS OF FACT AND APPROVING THE VACATION <br /> I OF 33 FOOT ROAD EASEMENT GENERALLY LOCATED NORTH OF lOth <br /> STREET AND SOUTH OF 1-694 SERVICE ROAD <br /> WHEREAS, The procedural history of the application is as <br /> I follows: <br /> l. That the two adjacent property owners requested <br /> the vacation of their petition of June 13, 1979. <br /> 2. That such petition was reviewed by the New <br /> Brighton Planning Commission Board of Review <br /> on June 19, 1979. <br /> 3. That the City Council, pursuant to published <br /> and mailed notices, held a public hearing on <br /> July 24, 1979, all person's present at the <br /> hearing were given an opportunity to be heard. <br /> 4. The written comments and analysis of the City <br /> staff, the Planning Commission minutes and <br /> recommendations were considered. <br /> NOW THEREFORE BE IT RESOLVED, That the New Brighton City <br /> Council makes the following Findings of Fact in respect to <br /> the proposed vacations: <br /> I l. That there are no plans to construct a public street <br /> on the easement. <br /> 2. That the road easement provides access to only one <br /> property owner. <br /> 'I 3. That the house at 800 lOth Street N.W. encroaches on <br /> the west 17.5 feet of the 33 foot easement which <br /> Ii limits the area available for a public street. <br /> II BE IT FURTHER RESOLVED that the following described <br /> ! road easement is and hereby vacated: <br /> I <br /> The east 33 feet of the south 345-84 feet of the <br /> SE ~ of the SW ~ of Section 20, Township 30, <br /> I Range 23, lyi ng north of the R/W 1 i ne of lOth <br /> Street N.~L <br /> and, <br /> I BE IT FURTHER RESOLVED that the approval of the road <br /> easement vacation is granted subject to the following <br /> conditions: <br /> l. That the underlying fee owners of land described <br /> as road easement will provide for a private <br /> I driveway easement and private utility easement <br /> for NSP for access to underground services on <br /> the east 15 feet of the east 33 feet of the <br /> south 345-84 feet of the SE ~ of the SW ~ <br /> I of Section 20, Township 30, Range 23, lying <br /> north of the R/W line of lOth Street N.W. <br /> I <br /> I <br />
