<br /> ) 'It," - """t <br /> - <br /> <' . <br /> ( <br /> RESOLUTION NO. 2173 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING APPLICATION <br /> FOR NC-38 UNDER CERTAIN CONDITIONS. <br /> WHEREAS an application for a non-conforming use permit <br /> ~ntitled NC-38 has been made by Belair Builders, Inc. to <br /> permit the construction of an industrial building on a site <br /> with existing Type IV non-conformities. <br /> WHEREAS the procedural history of the application is as <br /> follows: <br /> 1. That an application for a non-conforming use permit <br /> NC-38 was filed with the City of New Brighton on <br /> February 14, 1979. <br /> 2. That such application was reviewed by the New <br /> Brighton Planning Commission Board of Review on <br /> February 20, 1979. <br /> 3. That the City Council, pursuant to published and <br /> mailed notices, held a public hearing on March 13, <br /> 1979 all person's present at the hearing were given <br /> an opportunity to be heard. <br /> 4. The written comments and analysis of the City staff, <br /> the Planning Commission minutes and recommendations <br /> were considered. <br /> NOW THEREFORE BE IT RESOLVED, that the New Brighton City <br /> Council makes the following Findings of Fact in respect to I <br /> NC-38. <br /> l. That the following Type IV non-conformities exist <br /> on the property: <br /> A. Front yard parking in an industrial district. <br /> B. Lack of front yard landscaping in an industrial <br /> district. <br /> C. The existing building ha.s less than the required <br /> 15 foot side yard setbaek. <br /> 2. That the applicant has provided for the maximum <br /> amount of front yard landscaping that would be <br /> practical. <br /> 3. The limited amount of front yard parking is <br /> necessary for the operation of the various tenants <br /> of the building. <br /> 4. The applicant has done everything practical to <br /> eliminate and reduce the existing non-conformities. <br /> I <br /> I <br />
