<br /> and their fire department hereinafter referred to as the Fire Department, and,

<br /> hereinafter referred to as Capitol.City Mutual Aid Associationi--
<br /> WITNESSETH:
<br /> WHEREAS the parties hereto rle:'\ire to make avaiLtUi' to each other on a recriprocal basis their re-
<br /> spective firefighting equipment anr1 ;wrsom1f'l tn ('npe with ,.mel"gpl'riE's b<':"0no the :'\cope of any individual
<br /> party hereto. and
<br /> WHEREAS each parts- hert'lu has been duly auUl\!l'ized bS- competent authority to make, and enter
<br /> into such agreements, and to use its fire-fighting equipment and personnel outside their respective corporate
<br /> or municipal limits ;
<br /> 1. For the purpose of this agreement an "emergency" shall be defined as, but not limited to the
<br /> following: Fires, Drownings, Building Damage, Cave-ins, Accidents, Explosions, or other types of exigency
<br /> to which a fire department would respond.
<br /> 2. If one or more emergencies occur within the limits of any territory in which any of the members
<br /> of this agreement are authorized to furnish firefighting equipment and personnel and if in the judgment of
<br /> the Chief of the Fire Dept. in which the emergency exists, or in his absence, his assistant or deputy, the
<br /> equipment and personnel are insufficient to handle the emergency, the individual in charge may call one
<br /> or more of the FIRE DEPARTMENTS IN THE CAPITOL CITY MUTUAL AID ASSOCIATION which are
<br /> adjacent to the area in which the emergency exists.
<br /> 2. a. Should further equipment and personllel be needed he shall have authority to call any member
<br />if,: in THE CAPITOL CITY MUTUAL AID ASSOCIATION.
<br /> 3. Upon receipt of a call for assistance as set forth in paragraph 2. the fire department of any of the
<br /> parties hereto shall promptly dispatch requeflterl equipment and/or manpower to assist in fighting the fire
<br />~, which has caused the emergency or to render stand-by service as the case may be, pro1)ided that no fire
<br /> department of any of said parties shall be obligated to send its fire equipment or personnel beyond its
<br /> boundaries if to do so would leave such department without any fire equipment or personnel available within
<br /> its limits for service at any fire which might subsequently arise therein.
<br /> 4. The fire-fighting equipment and personnel of any fire department aflsiflting' the fire department of

<br /> 5. No charge will be made by any party for assistance rendered to another party ll11der this agree-
<br /> ment.
<br />~ 6. Each of the parties will maintain insurance policies covering:
<br /> (a) Accidental death of firemen (covered by workmen compensation) who is a member of said
<br /> parties' fire department, the coverage of said policy extending to protect said firemen of said parties when
<br /> engaged in the performance of duties under this agreement outside the boundary of the party of whose
<br /> fire department he is a member, and
<br /> (b) Damage or injury caused by negligent operation of its fire department vehicles to the ex-
<br /> tent of at least $50,000.00 property liability, and at least $300,000.00 personal injury liability, the coverage
<br /> of such policies extending to accidents which may occur \vhile the said party's fire department is engaged
<br /> in the performance of duties under this agreement outside of the boundaries of flaid party.
<br /> 7. No party to this agreement nor any officer or employee of any party shall be liable to any other
<br /> party or to any person on account of failure of any party to this agreement to furnish its fire-fighting
<br /> equipment or personnel in response to a call for assistance from any other department.
<br /> 8. Each party to this agreement hereby agrees to Hold Harmless any other party for any damage
<br /> caused while answering an emergency, whether caused by negligence or for any other reason.
<br /> 9. The Fire Department hereby agrees to become Members of THE CAPITOL CITY MUTUAL AID
<br /> ASSOCIA TION for the purpose of furthering the intent of this agreement and Said Association shall have
<br /> at least three meetings each year.
<br /> Each Fire Department shall be allowed one vote in the Association.
<br /> 10. Any Fire Department may withdraw from this agreement by thirty days notice in writing to the
<br /> Association.
<br /> 11. A COpy of this agreement will be posted at the fire department headquarters of each party heretu.
<br /> IN WITNESS WHEREOF the said Fire Departments have caused this agreement to be signed in their
<br /> respective corporate names by their respective duly authorized officers by authority of their respective gov-
<br /> erning bodies as of this 25 day of February 19, 66
