Paul, Minnesota 55104 <br /> PARKS AND OPEN 5 PACE AGREEMENT <br />Th i s Agreement, made and entered Into ttd 5_2Sday of. Apr I ! , 1967, by the <br /> ~ <br />Twin Cities Metropolitan Plall'H'llng Commission, hereinafter-referred to as the uPlanning <br />Commission," and NeW' Brighton, Mhll'lElsota, hereinafter referred to as the 'IPUb!11C Body.1I <br /> Wrrn~SSETH THAr; <br />WHEREAS, New Brighton, Minnesota, is authorized by law to exercise responsibilities <br />for the preservation of open-space land within its boundaries through acquisition by <br />gift, grant, devise purchase, or condemnation of ~ands which have value for park and <br />recreation purposes; and <br />WHEREAS, a comprehensive pian Is now being prepared by the Planning Commission, for <br />the physical growth and development of the territory within the boundaries of the seven- <br />county Twin Cities Metropolitan Area, which pian is being made with the general purpose <br />of guiding and coordinating the order~y growth and deve~opment of the Area; and <br />WHEREAS, the parties to this Agreement are ful~y cognizant of the need and urgency <br />of expediting the acquisition of ope~=space land in order to meet the recreation needs <br />of a rapidly expanding population, In accordance with orderly and cooperative plans and <br />procedures, and recognize that Tii'[e VI l of the United States Housing Act of 1961 and <br />the Land and Water Conservation Act of 1965 are valid methods of encouraging and <br />assisting Pub~lc Bodies in the acquisition of addli'!onal open-space land; <br />NOW THEREFORE, the Planning Commlsslon and the Public Body agrees as fo~lows: <br />I . The Public Body wiil prepare long-range recreation and open-space plans <br />for their respective judsdlctlons, in cooperation with the Planning Commission. <br />On cOmpletion, such p!al!'\s wi~ i be certIfied as to conformance with the comprehensive <br />pian now being compieted by the Commission. <br />2. The Public Body, in acquiring add~tional open-space land within its respective <br />jurisdictions wi II do so in accordance with its official open-space plans. <br />3. The Public Body wil! use its best efforts to implement its official open-space <br />pians with or without the use of grants under the Federal Open-Space land Program. <br />4. Where grants are received under the Federal Open-Space land Program, the Public <br />Body wil! provide the local funds as needed and wi!! use their best efforts to <br />Increase their open-space land programs In proportion to any such grants received. <br />5. Prfo~ to the acquisition of open-space land, or prior to the filling of an <br />application for federal grant under Title VII of the Housing Act of 1961, each <br />Pub! Ie BOdy shall submit an open-space land acqulsltior. program to the Planning <br />Commission for review as to conformance with the comprehensive pian now being <br />completed under the Joint cProgram for Land Use-Transportation Planning. Each <br />Public Body shal I be guided by the reviews, plans and policies of the P!annlng <br />Comm) ss Ion. <br />6. Nothing contained herein Is intended to require a Public Body to take any action <br />whlch it is not authorized to take, or to refrain from any action which it Is <br />not authorized to take, or to refrain from any action which it is required to take, <br />pursuant to the federal, state, or local !aw under which it exercises responslbilitles <br />for the acquisition and preservai'lon of OpEH1~space land. <br />7. This Agreement shall take effect upon execution by ~! I Parties mentioned in the <br />Preamble. Thereafter, additional Public Bodles may, from time to time, execute this <br />Agreement and such execution subsequent to the date of this Agreement shal i not be <br />deemed to require its re-execution by any Pady which had theretofore executed the <br />same. <br />This Agreement shal I al low parties not satisfied with the performance of same to with- <br />draw upon sixty days written notice t'o the other signatories. <br /> , , <br />
