<br /> .. <br /> " .., <br /> ~ .. <br /> RESOLUTION NO. 532 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> VILLAGE OF NEW BRIGHTON <br /> RESOLUTION AUTHORIZING MAYOR AND MANAGER TO EXECUTE <br /> DOCUMENT TO PURCHASE LANDS FOR PARK PURPOSES ~~OWN <br /> AS FOSS ROAD PARK SITE <br /> WHEREAS, The Village Counci I by Resolution *380, authorized and <br /> directed the acquisition of certain lands for park purposes by <br /> negotiation or condemnation, and <br /> WHEREAS, pursuant to such Resolution, appraisals of the Foss Road Park <br /> Site were obtained, Joseph L. Bettendorf having appraised said <br /> land, value at $30,000.00, and Wi I I iam H. Muske having <br /> appraised said land, value at $32,500.00, and <br /> viHEREAS, failing successful negotiation for the purchase of said land, <br /> a condemnation proceeding for its acquisition was initiated by <br /> the service of a notice upon all parties having an interest <br /> t:lere in, and <br /> WHEREAS, on March 12, 1968, the OWners of said land offered in writing <br /> to sell such parcel to the Vi Ilage for the sum of $30,000.00, <br /> and <br /> WHEREAS, such price appears to be fair and reasonable and consistent <br /> with appraised value, <br /> NOW THEREFORE BE IT RESOLVED by the Vi I lage Counci I of New Brighton <br /> as f 0 1 I Ow s : <br /> I . The Mayor and Manager are hereby authorized and directed <br /> to execute on behalf of the Vii lage of New Brighton an acceptance of <br /> the written offer to sel I, a copy of such purchase agreement being <br /> attached hereto and being made a part of. <br /> 2. The Vii lage Clerk Treasurer be authorized and directed to <br /> issue check number 002049 of the Vii lage of New Brighton for the sum <br /> of $100.00 as and is earnest money pursuant to said purchase agreement. <br /> --, That the Mayor and Manager are hereby authorized and directed <br /> .:J. to execute al I documents necessary to carry out the terms of said <br /> purchase agreement. <br /> 4. That the Vi I lage Clerk Treasurer is hereby authorized and <br /> directed to pay the balance of said purchase price, $29,900.00 at the <br /> closing of said transaction conditioned only upon receipt from the <br /> Vi I lage Attorney of a letter stating that such payment wil I vest in the <br /> Village, title to said property, free and clear of all encumbrances. <br /> 5.
