The Village of New Brighton agrees to be responsible for any damage to the easement premises or improvements hereafter erected on said easement premises caused by explosions or other matters incidental to the sewer. 5. The Village of New Brighton agrees that it will furnish to owner-respondents, or their successors, or as signs, a certificate by the village engineer in a recordable form, that any structure built on the easement has been constructed in compliance with all engineering requirements of this Stipulation. 6. The Village of New Brighton agrees that it will, as a condition precedent to the filing of this Stipulation and the dismis sal of this action, adopt a resolution that the Village of New Brighton accepts all the conditions in this Stipulation. The Village will further furnish to owner-respondents, or their successors and as signs, in a recordable form, a certified copy of said resolution. 7. The Village of New Brighton agrees to furnish to owner-respondents, their successors or assigns, a certificate, in recordable form, by the Village Attorney that the Village of New Brighton has the authority to enter :into the agreement set forth herein which limits its rights in the easement. IT IS FURTHER STIPULATED by and between the Village of New Brighton, petitioner, and Fred Beis swenger, Julie Beis swenger and Rose Johnson, owners of Parcel No. 84 and respondents herein, that upon the performance by the parties of the agreements set forth in this Stipulation that they will execute a Stipulation for dismis sal with prejudice of the above entitled action.
