<br /> , BE .IT RESOLVEDhy the Village Counci'l of the, Village of New
<br /> Brighton, Minnesota as follows:
<br /> WHEREAS'pursuant to proper notice duly given as required by
<br /> law theVill~9~ Council has met and heard and passed upon all
<br /> objections to,the proposed assessment for the improvement of:
<br /> '.Fi.rst street N.W. from Old Highway 8 to 5th A~enue N.W.
<br /> Fifth Avenue N.W. from First Street'N.W. to Fifth Street N.W.
<br /> By: Right of way acquisition,' grading, sanitary sewer,
<br /> :wate~main, storm sewer, gravel base, bituminous base,
<br /> sur:fac'ing, concrete curb and gutter
<br /> ..
<br /> NOW';THEREFORE BE IT J;lESOLVED BY THE VILLAGE COUNCIL OF NEW

<br /> l~ That the 'benefits of such improvement are hereby found
<br /> , to, be in part a general benefit to the Village ,and in part a
<br /> specific benefit to abutting properties. That the State Aid funds,
<br /> 'received from the State of Minnesota and applied to the cost of
<br /> this improve.merit are foundto'be equal to or greater than the
<br /> general benefit to the Village and the remaining costs are hereby
<br /> found to pe substantially equal to or less: than ~he special
<br /> 'benefits to the abutting property and::iit is, further found that each
<br /> parcel, of ,.property abutting upon said improvement is' specifically
<br /> and specially benefitted inanaIDount equal to' or $ubstantially
<br /> equal to the amount of the assessment levied against it by this
<br /> resolutioh. .That such determinations herein contained are based
<br /> in part ,upon an appraisal~ evaluation and recommendation, of a
<br /> competent, professional real estate appraiser who was hired by and.
<br /> :r:eported 'to ,the Village of New Brighton for the purpose of .
<br /> determining the be.nefits of the property hereby assessed by reason
<br /> of Improveme~t 67 7.
<br /> 2. Such proposed assessment, a copy .or which, is attached
<br /> hereto, and made a part pereof, is hereby accepted and shall
<br /> constitute the special assessment against the lands named therein,
<br /> and each tract of land therein included is hereby found to be
<br /> benefited by t,heproposed improvement in the amount of the assess-
