RESOLUTION NO. <br /> t <br /> . <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION GRANTING MENGELKOCH COMPANY AN OFFENSIVE TRADES <br /> LICENSE AND AFFIXING CERTAIN CONDITIONS OF OPERATION <br /> WHEREAS the City of New Brighton is responsible for the <br /> general safety, health, welfare and well-being of its residents <br /> and has established codes to aid in carrying out this responsi- <br /> bility, and <br /> WHEREAS City Code Sections 265 entitled Sewer Department <br /> Regulations and 860 entitled Offensive Trades, and Metropolitan <br /> Sewer Board Rules and Regulations for the Metropolitan Disposal <br /> System and the Minnesota Pollution Control Agency Standards <br /> all apply to the operation of Mengelkoch Company as a rendering <br /> business, and <br /> WHEREAS the City is aware and has been informed of <br /> certain deficiencies in the operation of Mengelkoch Company <br /> with respect to these codes, ru les , regulations and standards, <br /> and i <br /> WHEREAS, these deficiencies affect the safety, health, <br /> welfare and well-being of its residents in that it causes <br /> plugging of the sanitary sewer and lift station, interferes <br /> with sanitary sewer service to otherq, results in raw sewage <br /> being dumped on the open ground, and often results in offensive <br /> odors in the neighborhood. <br /> NOW THEREFORE BE IT RESOLVED, That the Offensive Trades <br /> License of Mengelkoch Company be granted under the following <br /> conditions: <br /> l. That deviation from the recommendation of MPCA <br /> with regard to keeping all doors and windows closed <br /> so that all rendering plant air will be processed <br /> through a scrubber or burned will be cause for <br /> revocation of their offensive trades license. <br /> 2. That any plugging or impairment of the operation <br /> of the city sewer system with grease will be <br /> considered prima facie evidence that Section 265:06 <br /> Subd. , 2 of the City Code, Section 860:20 of the City <br /> Code, Article V, Section 5-4A of the Rules and <br /> Regulations for the Metropolitan Sewer Disposal <br /> System have been and are being violated and that <br /> the right of the rendering plant to use the City <br /> sewer system is thereby immediately suspended <br /> and suspension or revocation of the offensive trade <br /> license will be considered. The amount of grease <br /> discharged into the City sewer system shall be 100 <br /> mg. per liter or less beginning on March 7, 1975 <br /> and continuing as long as this license is in force. <br /> ~ <br />
