T HOLD HARMLESS AGREEMENT WHEREAS~ the undersigned~ first parties~ are the owners of the property known as Lot 15, Block 1, Koons-Devener Addition, located in the City of New Brighton, Ramsey County, Mi.nnesota. WHEREAS, the City of New Brighton, second parties, hold an interest in R certain easements located on the herein described property. WHEREAS, the City Council of the City of New Brighton~ second parties~ has I . agreed to release, in part, its interest in said easements by execution of Quit Claim Deed or Deeds requested by first parties. '" WHEREAS~ one of the herein above described easements is legally described as follows: A 20 foot permanent sewer easement over that part of Lot 15, Block 1, Koons-Devener Addition, Ramsey County~ Minnesota~ the center line of which is described as follows: Beginning at a point on the center line of Brookside Road District 125.90 feet .,.. west of the center line of Thorndale Avenue; thence southeasterly po-. .. by an angle of 32 degrees~ 34 minutes, as measured from the :z: center line of Brookside Road to the easterly line of said Lot l5~ "'- ,., and there terminating. .... - NOW, THEREFORE~ in consideration of said City of New Brighton releasing by ~ way of Quit Claim Deed its interest in said sanitary sewer easement to the - extent that a dwelling house located on said Lot 15 encroaches upon said :z sanitary sewer easement, first parties agree to the following: In the event = -;) that~ and only in the event that~ second parties find it reasonable and necessary, after consideration of all alternative means, to enter upon said ~. sanitary sewer easement to effect necessary repair or maintenance after consideration of all available means holding the least possible risk to said dwelling house, first parties hold harmless and release the City of New I Brighton ~ its employees and agents, from any and all known or unknown re- sponsibility or liability resulting from reasonable and necessary repair and ~ maintenance of the sanitary sewer located within said sanitary sewer easement ~ which responsibili.tymay accrue by reason of the location of the dwelling ~ house located within said easement and only for said reasons, liability~ '-N ~ repair and maintenance. ~ 0 ~ IN WITNESS HEREOF, the first parties have set their hands the day and year hereinafter written.
