<br /> J' ~ <br /> . <br /> -. <br /> T <br /> HOLD HARMLESS AGREEMENT <br /> WHEREAS~ the undersigned~ first parties~ are the owners of the property <br /> known as Lot 15, Block 1, Koons-Devener Addition, located in the City of <br /> New Brighton, Ramsey County, Mi.nnesota. <br /> WHEREAS, the City of New Brighton, second parties, hold an interest in <br /> R certain easements located on the herein described property. <br /> WHEREAS, the City Council of the City of New Brighton~ second parties~ has <br /> I <br /> . agreed to release, in part, its interest in said easements by execution of <br /> Quit Claim Deed or Deeds requested by first parties. <br /> '" WHEREAS~ one of the herein above described easements is legally described <br /> as follows: <br /> A 20 foot permanent sewer easement over that part of Lot 15, <br /> Block 1, Koons-Devener Addition, Ramsey County~ Minnesota~ the <br /> center line of which is described as follows: Beginning at a <br /> point on the center line of Brookside Road District 125.90 feet <br />.,.. west of the center line of Thorndale Avenue; thence southeasterly <br />po-. <br />.. by an angle of 32 degrees~ 34 minutes, as measured from the <br />:z: center line of Brookside Road to the easterly line of said Lot l5~ <br />"'- <br />,., and there terminating. <br />.... <br />- NOW, THEREFORE~ in consideration of said City of New Brighton releasing by <br />~ way of Quit Claim Deed its interest in said sanitary sewer easement to the <br />- extent that a dwelling house located on said Lot 15 encroaches upon said <br />:z sanitary sewer easement, first parties agree to the following: In the event <br />= <br />-;) that~ and only in the event that~ second parties find it reasonable and <br /> necessary, after consideration of all alternative means, to enter upon said <br />~. sanitary sewer easement to effect necessary repair or maintenance after <br /> consideration of all available means holding the least possible risk to said <br /> dwelling house, first parties hold harmless and release the City of New <br /> I Brighton ~ its employees and agents, from any and all known or unknown re- <br /> sponsibility or liability resulting from reasonable and necessary repair and <br />~ maintenance of the sanitary sewer located within said sanitary sewer easement <br />~ which responsibili.tymay accrue by reason of the location of the dwelling <br />~ house located within said easement and only for said reasons, liability~ <br />'-N <br /> ~ repair and maintenance. <br /> ~ <br /> 0 <br /> ~ IN WITNESS HEREOF, the first parties have set their hands the day and year <br /> hereinafter written. <br /> Dated this ,I day of L , 1974. <br /> ( .J &tL <br /> This instrument was drafted by: <br /> ,/ .-1r~~L2~ <br /> Perry W.
