'" <br /> RESOLUTION NO. 1344 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> lESOLUTION DETERMINING THAT NO VARIANCE IS REQUIRED TO PERMIT <br /> ROPOSED ADDITION TO THE CLINIC BUILDING LOCATED AT 830 5th AVENUE <br /> r.w. <br /> WHEREAS Dr s . Scanlon and Buscher propose to construct a <br /> 19' x 26' addition on the west side of the existing clinic <br /> building at 830 5th Avenue N.W.; and <br /> WHEREAS an application for a variance to'permit pa:rking <br /> within the front yard setback area has been received, <br /> NOW THEREFORE BE IT RESOLVED, by the New Brighton City <br /> Council as follows: <br /> 1. Parking within the front yard setback area on the subjec'l: <br /> property has in fact regularly and consistently existed <br /> all the way to the front property line since long before <br /> the adoption of the 1964 comprehensive zoning ordinance <br /> and therefore is a legal nonconforming use: <br /> 2. The subject clinic building, together with the proposed <br /> addition, will have off street parking, exclusive of <br /> areas within setback areas, which more than'meets the <br /> off street parking requirements of the zoning code: <br /> 3. The proposed building addition does not in any way <br /> create, expand or enlarge any existing non-conforming <br /> use of the subject property: <br /> 4. The existing front" yard parking is used in conjunction <br /> with other adjacent front yard parking under a joint <br /> and cooperative common parking ag~eement with other <br /> adjacent commercial ,property owners. <br /> 5.
