Specific <br /> provisions for treatment of items such as this can create <br /> a lack of flexibility in the bill which may be detrimenta:; <br /> to the consumer, particularly if the company has large sw <br /> swings in construction work in process. <br /> 7. The bill provides for future test year. The regulatory <br /> body should be allowed flexibility, in regard to the <br /> determination of the test year. <br /> 8. According to the bill, the state Environmental Quality <br /> Council has the right to determine plant location. To <br /> avoid potential inter-agency conflict, a procedure should <br /> be instituted so that the state Public Servire Commission <br /> would determine the need before the Environmental <br /> Quality determines the location, <br /> 9. The bill is unclear in regard to franchising and should <br /> be made clear as to what areas will remain for local <br /> franchising. <br /> 10. The percentages in Section 2 and 3 of the bill should be <br /> checked to see if sufficient revenue would be available <br /> to provide for competent rate and policy regulation. <br /> 11. It appears the bill includes regulation of gas for resale. <br /> This raises a legal question of whether the Federal <br /> Power Commission has jurisdiction over the state and <br /> whether the state can take jurisdiction away from the <br /> Federal Power commission. <br /> BE IT FURTHER RESOLVED that the'City Clerk be and is hereby <br /> ,directed to send a copy of this resolution to New Brighton's <br /> representatives to Minnesota Legislature. <br /> Adopted this 12th day of February 1974~ <br /> '~e:~ <br /> Mayor <br /> ATTEST: <br /> ~ fL,-9j)~ <br /> Vernon C.
